AUCTION TERMS AND CONDITIONS SPECIAL NOTE FOR THIS AUCTION: Many descriptions for items in this auction have been provided in part or in full by the consigner any may not have been independently verified. Any items still sealed in original packaging have not been opened in order to preserve their integrity. We have done our best to accurately describe all items but items may not include all original pieces or be in full working order. All bidders are invited to preview in person prior to the auction. We are open Monday-Friday 9am-4pm, we will NOT be open on Sunday August 3rd. Earliest pick up time will be Tuesday August 5th at 9am. 1. Bidding on any item in this auction constitutes the bidder's acceptance of these Terms and Conditions. PLEASE READ THESE TERMS IN FULL PRIOR TO BIDDING. 2. ALL SALES ARE FINAL. This is NOT a retail environment; this is a FINAL SALE AUCTION. There are no cancelations, returns, restocking, refunds, or exchanges. NO EXCEPTIONS. According to Texas law a winning auction bidder automatically enters a legal and binding purchase contract with the auction house. Gallery Auctions has a ZERO TOLERANCE Policy regarding non-paying bidders and will pursue all available options to collect on any unpaid invoices. Storage fees and legal/collection fees may also be added to past due invoices. 2A. We will not cancel the sale of an item due to an accidental click, technical error, or user error. Regardless of the circumstances, if you place a bid and subsequently win that item, you have purchased it. 2B. Gallery Auctions DOES NOT give refunds or accept returns based on condition or accuracy of an item?s description. 3. All items are sold AS-IS, WHERE-IS with no warranties or guarantees expressed or implied. This is NOT a retail environment; this is a FINAL SALE AUCTION. 4. If an estimate is given for a lot, it should not be relied on as a prediction of the actual selling price. Gallery Auctions reserves the right to change the starting bid, asking bid or estimates on any lot at any time. Some items in this auction may have reserves. Consigners or their agents may not bid on their own items, however, Gallery Auctions may advance the bid on behalf of the consigner to meet an items reserve price. The auctioneer may pass or withdraw an item at any time before it is pronounced sold. 5. Gallery Auctions makes no guarantees or warranties of any kind with respect to the property or its value, and in no event will Gallery Auctions be responsible for the accuracy of an item's description, condition or estimate of value. Descriptions & conditions provided are opinions only, they are not representation of warranties AND SHOULD NOT BE RELIED UPON AS A STATMENT OF FACT. Statements and descriptions contained in the catalog, bill of sale, invoice, by auctioneer or elsewhere as to the manufacturer, artisan authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, historical relevance or physical condition ARE QUALIFIED STATEMENTS OF OPINION ONLY AND ARE NOT REPRESENTATIONS OR WARRANTIES. Gallery Auctions may update or remove a condition report or description at any time before the auction starts. All items will be available for preview and inspection prior to the auction. All bidders or their agents are encouraged to preview in person. You may also request a more detailed condition report and/or photos prior to the start of the auction. Any statements made in condition reports are our opinion only AND SHOULD NOT BE RELIED UPON AS A STATMENT OF FACT. The photos provided form a portion of the condition report. 5A. Bidders are advised that not all damage (such as, but not limited to damage inside, behind & under items, Insect damage / infestation, mold / mildew or structural issues) may be visible to our catalog team or shown in the photos. Stone / Marble may have cracks, chips or chunks missing that are not visible to our catalog team or shown in the photos - ALL BIDDERS ARE ADVISED TO ASK QUESTIONS OR ASK FOR MORE PHOTOS PRIOR TO BIDDING. 6. The auctioneer reserves the right to reject a bid from any bidder. The winning bidder will be the highest bidder as determined by the auctioneer. The auctioneer has sole authority to resolve any disputes. Gallery Auctions will not be responsible for any failure to execute absentee, electronic or phone bids due to human error or electronic failures of any kind. The Auctioneer may pause or end the auction at any time. ABSENTEE BIDS CANNOT BE RETRACTED LESS THAN 2 HOURS PRIOR TO THE LISTED AUCTION START TIME OR ONCE THE AUCTION HAS STARTED. If the Auctioneer reduces a bid and a bid is submitted at a higher amount the auctioneer may choose to accept the higher bid amount and is not obligated to reduce the bid to the lower asking amount. 7. Some lots may not include accessories such as keys, shelves, hardware, rails, lids, brackets, crystals, prisms, weights, pegs etc. Gallery Auctions is not responsible for any missing accessories or incomplete lots. Buyers are advised to review photos and descriptions carefully to determine included accessories and to ask questions before bidding. If an accessory is shown in the photos or mentioned in the description, then it is part of the purchase. If an accessory is not shown in the photo or listed in the description, it is NOT part of the purchase. Please ask about any spare/replacement keys or accessories when picking items up as that is the time to have a chance of locating any spare or replacement accessories for any missing items. Please instruct delivery services to do the same & to handle keys/accessories with care. 8. Any statement by the auctioneer or staff, written or oral, before, during or after the auction regarding condition, age or authenticity etc. are opinion only AND SHOULD NOT BE RELIED UPON AS A STATMENT OF FACT.. It is the Bidders responsibility to ensure that the condition of the lots meet with their satisfaction BEFORE bidding. 9. The purchaser assumes full responsibility for items at the fall of the hammer. Gallery Auctions is not responsible for the loss of any item or for damage to a lot after the lot is pronounced sold. This includes but is not limited to any damage incurred from storage or movement in our warehouse, while loading, during transport / delivery or when removing any lot stickers or identifying tags. Gallery Auctions will in no way be liable for damage caused to any person or their property by any item or its contents once it is pronounced sold. 10. All measurements and weights are approximate, rounded up to the nearest inch & provided for shipping estimation purposes only, with no guarantee of accuracy. If you require exact measurements please use the "ask a question" button on the item page. 11. A 23% buyers premium will be added to the hammer price of each lot sold thru Liveauctioneers. 12. Internet purchases from Gallery Auctions will be subject to sales tax. We fully comply with sales tax NEXUS laws and YOUR PURCHASE IS SUBJECT TO SALES TAX unless you are a tax exempt reseller. Any sales tax shown on your invoice is collected and remitted by liveauctioneers based on the shipping address. IF YOU ARE AN OUT OF STATE BUYER AND YOUR INVOICE SHOWS SALES TAX YOU MUST PAY THRU LIVE.PAYMENTS, NO EXCEPTIONS. If you are tax exempt, you can submit your tax exempt certificate to liveauctioneers to prevent the collection of tax. As required by law sales tax is charged on the TOTAL purchase price (Hammer Price + Buyers Premium). 13. We will be using the INSTANT AUTOPAY FEATURE for this auction, your preferred credit card / bank account on file with Live.Payments will be charged IMMEDIATELY after the conclusion of the auction. If you have questions about the autopay feature please call us at prior to the start of the auction. If the autopay does not go thru for your invoice PAYMENT MUST BE PAID IN FULL WITHIN 24 HOURS of the auction, NO EXCEPTIONS. Our preferred payment method is via Credit Card or ACH Bank Transfer on Live.Payments, you can find a link in your WON ITEMS SECTION ON LIVEAUCTIONEERS to Live.payments - WE DO NOT ACCEPT PAYPAL, ZELLE, CASHAPP or VENMO ECT. - Multi-card transactions are not supported by Live.Payments. You may also pay in cash at our facility - NO CHECKS. In some circumstances bank wire transfers can be accepted with preapproval. No merchandise will be released until payment has been made in full for all open invoices and any storage charges. IF YOU ARE AN INTERNATIONAL BUYER, YOU MUST PAY VIA LIVE.PAYMENTS OR BANK WIRE, NO EXCEPTIONS. PLEASE CALL US FOR INSTRUCTIONS. 13A. Gallery Auctions has a ZERO TOLERANCE Policy regarding non-paying bidders & will pursue all available options to collect on any unpaid invoices. Storage fees as outlined in the terms for this auction & legal/collection fees may also be added to past due invoices. 13B. Due to recent fraudulent activity Gallery Auctions reserves the right to deny certain types of payment or require payment via cash or direct bank wire transfer ( not ACH Transfer) at their sole discretion for any reason. Please call us with any questions or concerns prior to bidding. 13C. Failure to pay for any item within FIVE days will initiate the Liveauctioneers dispute process & any items not paid for within 10 days may be resold with no notice due to the buyer. If a bidder requests for a dispute to be lifted and the item is no longer available Gallery Auctions reserves the right to collect/retain the buyer's premium as a service fee for removing the dispute. 13D. In the event a chargeback / credit card dispute is initiated by the bidder a $150 administrative fee will be charged using the AUTO PAY system. No merchandise will be released until the chargeback / credit card dispute is settled & ALL storage & administrative fees are paid in full. 13F. Bidders must have a validated method of payment on file in order to be approved to bid in this auction. A bidder's registration may be declined for a low payment rate. If your registration for this auction is declined please reach out to us via the LiveAuctioneers messenger service for assistance. 14. GALLERY AUCTIONS DOES NOT OFFER IN HOUSE SHIPPING OR PACKAGING SERVICES OF ANY KIND. Gallery Auctions does not offer tracking information as we DO NOT SHIP any items. We do allow bidders to set up their own shipping and will bring items to our loading dock for shipping companies. We do not collect any fees for delivery services or shipping. Gallery Auctions is not responsible for delivering items won at auction to the bidder ? we offer local pick up. 14A.We have staff to assist bidders with loading their own items, please bring blankets and tie downs/straps if possible. For delivery services we locate the items in our building and generally bring the items to our loading dock for transport, the delivery service is responsible for loading and packing the items they are transporting. We have a list of recommended shippers on our website under essential info on our website. www.galleryauctions.com/delivery These businesses have been used by our customers with success but are in no way affiliated with or endorsed by Gallery Auctions. Gallery Auctions does not guarantee successful, timely or intact deliveries from any independent delivery whether they are on our recommended delivery page or not. Any shipping service is used at the bidder?s own risk & the bidder releases Gallery Auctions from any liability. 14C. LiveAuctioneers has partnered with vetted providers to offer convenient shipping within the U.S. for purchases in this auction. The estimated shipping cost is based on the zip code you provided, the estimated size and weight of the item, and the designated shipping vendor. The cost includes item pickup, packing, shipping, delivery and insurance. Your actual shipping cost is subject to change based on the final price and insurance value of your item. If you do not see an estimated shipping cost in your invoice or on the item page, and would like to request a free quote, please contact them at packaging@liveauctioneers.com or 929-314-5567. This service is optional and can be added up to 10 days after the conclusion of the auction, some exclusions apply. 14D. Gallery Auctions WILL NOT cancel the sale of item due to a price difference in a pre-auction shipping estimate and a post auction shipping cost. Gallery Auctions will not cancel the sale of item due to high shipping costs - shipping can sometimes cost more than the price of the item, bidders are advised to obtain shipping quotes prior to bidding. 14E. Gallery Auctions is in no way responsible for any items that are damaged in transit, late or do not arrive at all. It is important to understand that GALLERY AUCTIONS DOES NOT SHIP. We allow bidders to use independent third-party shippers or pick items up themselves. This means we will not be held responsible for any damage to an item once it leaves our facility or for any item that fails to be delivered. Gallery auctions DOES NOT agree in any way to provide the safe or timely delivery of any items won at our auctions. We provide pick up at our warehouse, not delivery. It is the bidders responsibility to collect or arrange shipping for items won at Gallery Auctions. 15. It is the responsibility of the buyer to remove purchased property at his or her expense after the auction, or to MAKE SHIPPING ARRANGEMENTS. Please note that shipping charges can be expensive, in some cases more than the cost of the item, it is strongly recommended that bidders obtain a quote prior to bidding. It is the buyer's responsibility to get any quotes & coordinate pick up of their item. IF YOU ARE UNABLE TO PICK YOUR ITEMS UP AND ARE UNABLE OR UNWILLING TO COORDINATE SHIPPING OF YOUR ITEM YOU ARE ADVISED NOT TO BID. 16. GALLERY AUCTIONS IS NOT A STORAGE FACILITY. All items must be removed from Gallery Auctions premises or have shipping arrangements in place (meaning you have a shipper set to pick up and they have given you a pickup date) within TEN (10) days following the auction. Notification of shipping arrangements or requests for additional time must be submitted via Liveauctioneers Message or Email - Verbal/Phone notification is not acceptable. If you do not receive a reply from us confirming receipt of your message / email, then we did not receive it & you should continue to contact us. 16A. Failure to remove the items within the allotted time will result in storage charges at the rate of $10 per lot, per day, starting at the date of sale. Once storage charges begin to accrue no items will be released until the storage charges are paid for in full. ANY ITEMS LEFT LONGER THAN 30 DAYS WITHOUT PRIOR WRITTEN/EMAILED AND AGREED TO ARRANGEMENTS WILL BE TREATED AS ABANDONED AND MAY BE DISPOSED OF OR RESOLD WITH NO NOTICE GIVEN OR REFUND DUE TO THE ORIGINAL BUYER. Gallery Auctions DOES NOT provide reminder phone calls or emails for items that are not picked up from our warehouse 16B. Gallery Auctions DOES NOT accept the reconsignment of unwanted lots (in whole or in part) that customers purchased during one of our auctions. Unwanted lots may be abandoned by the buyer by providing written/emailed and agreed to notice. Any lots left longer than 30 days without prior written/emailed and agreed to arrangements will be treated as abandoned. 16C. If storage fees are added to your invoice, and we will use the INSTANT AUTO PAY feature to collect the fees. 17. ANYONE OR ANY DELIVERY SERVICE PICKING UP ITEMS FOR SOMEONE ELSE MUST PRESENT A COPY OF THE INVOICE(S) OR A DELIVERY ORDER/WAYBILL THAT SHOWS THE INVOICE NUMBER, NAME OF PURCHASER & LISTS ALL ITEMS BEING PICKED UP. This enables us to have a two-way verification system and ensure that all items are accounted for, and all the items are picked up. Gallery Auctions is NOT responsible for any costs or inconveniences caused due to incomplete deliveries. Pick up hours are Tuesday-Friday 8:30am-Noon & 1:30pm-4:30pm. WE CLOSE PROMPTLY AT 4pm ON FRIDAYS. No weekend pickup. 18. It is the Bidders responsibility to ensure the condition of the lots meet with their satisfaction BEFORE bidding. Most items are preowned and will have signs of use. New items may have flaws or show signs of handling. ALL BIDDERS ARE ADVISED TO ASK QUESTIONS PRIOR TO BIDDING. While great care is given regarding condition classification, all statements regarding condition are opinion only AND SHOULD NOT BE RELIED UPON AS A STATMENT OF FACT, please review the photos carefully, Gallery Auctions assumes no responsibility for any error or omission. IF YOU ARE IN DOUBT THAT THE LOT WILL MEET WITH YOUR SATISFACTION YOU ARE ADVISED NOT TO BID. 19. Gallery Auctions has a Zero Tolerance policy regarding abusive or aggressive behavior. Harassment, Physical and/or Verbal abuse of our staff or customers in person, via telephone or electronic communication will not be tolerated. Should someone engage in abusive/aggressive behavior a warning may be given or the interaction may be ended. At our discretion they may be asked to leave, have communication blocked and/or not be allowed to return or participate in future auctions. We are a family run auction company that prides itself on great customer service. We treat everyone as we would want to be treated and simply ask that you do the same. 20. Winning bidders email addresses will automatically be added to our inhouse mailing list. You may opt out by clicking the manage my subscription link at the bottom of any email you receive from us. 21. An explanation of condition grades for our Preowned Designer Goods: AA= practically perfect: has barley been worn, kept in excellent shape, this is the best second hand condition. A=Excellent Condition: May show some signs of wear, perhaps a small watermark, mild discoloration or scuffs in an isolated area, minimally used, maintains structure & hardware is intact. AB=Very Good Condition: Regular signs of wear, has been used often but kept in good condition. Can show watermarks, discoloration or scuffs in areas, Hardware intact by may be very mildly tarnished. B=Good/Fair Condition: Well used patina, may have some cracks and stains, hardware can be tarnished, overall structure is intact. .BC or C=Poor Condition : This item has been used extensively, likely has lots of wear / some damage, may be missing components. Sold for historical or collectible purposes only. . All Bags are Preowned may show signs of use & may have odors. It is the Bidders responsibility to ensure the condition of the lots meet with their satisfaction BEFORE bidding. Bidder agrees that all disputes arising under this agreement shall be brought exclusively in the Judicial District Courts of Harris County, Texas. Bidding on any item in the auction indicates the bidder's acknowledgement of & agreement to the above terms.
