All auctions conducted by Candlelit International Auctions are governed by the following terms and conditions. Please read them carefully before registering or placing any bids. By registering to bid or placing a bid on any item, you acknowledge and agree to be legally bound by these terms and conditions. If you do not understand or agree to any part of these terms, we kindly ask that you refrain from bidding. Bidding constitutes a legally binding contract. You affirm that you have either examined the items, waived your right to examine them, or appointed an agent to examine them on your behalf. If you are the highest bidder at the close of the lot, you are legally obligated to purchase the item. Please bid responsibly. Sales Tax All online purchases are subject to applicable state and local sales tax based on the buyer?s shipping address. Purchases shipped to Florida are subject to a total sales tax of 7% (6% state tax plus 1% county surtax), calculated on the hammer price. Purchases shipped to New York are subject to New York State and any applicable local sales taxes, calculated on the hammer price. Sales tax will not be charged if a valid tax exemption certificate has been uploaded to your LiveAuctioneers account and verified prior to bidding. We are required by law to collect sales tax if the certificate is not validated. Autopay Policy If payment has not been arranged within three (3) calendar days of receiving your invoice, Candlelit International Auctions reserves the right to automatically charge the credit card used at registration for the full amount due, including buyer's premium, tax, and applicable shipping charges. Buyer's Premium All successful bids are subject to a buyer's premium, applied to the hammer price, as follows: 25% for hammer prices up to $50,000.00 24% for hammer prices between $50,000.01 and $100,000.00 20% for hammer prices exceeding $100,000.01 The buyer's premium is calculated per lot and aggregated on your invoice total. Premiums are non-negotiable unless otherwise stated in writing by Candlelit International Auctions. Authenticity Disclaimer All property is sold "as is, where is, with all faults." Candlelit International Auctions makes no warranties or representations, express or implied, as to the authenticity, authorship, age, origin, condition, or provenance of any item. Descriptions and condition reports are offered as a courtesy and are based on the best available information at the time of listing. They do not constitute a guarantee or warranty of any kind. It is the buyer's responsibility to conduct their own due diligence or to engage an independent expert prior to bidding. Returns & Refund Policy All sales are final. Returns will only be considered at the sole discretion of Candlelit International Auctions and must be requested in writing within three (3) days of receiving the item. The request must state in full the grounds for return. Approval is not guaranteed and return shipping costs are the buyer's responsibility unless otherwise agreed in writing. Indemnification Clause All bidders and buyers agree to indemnify and hold harmless Candlelit International Auctions, its affiliates, owners, employees, and agents from any and all claims, damages, losses, or liabilities arising from participation in the auction, including but not limited to bidding errors, misunderstandings, or disputes. Jurisdiction & Governing Law These terms and conditions are governed by the laws of the State of Florida. All disputes arising from or related to these terms, or any auction conducted by Candlelit International Auctions, shall be resolved exclusively in the courts located in Miami-Dade County, Florida. Limitation of Liability In no event shall Candlelit International Auctions or its representatives be liable for any damages, including but not limited to incidental, consequential, punitive, or indirect damages, arising out of or related to participation in any auction or purchase of any item.

If you have not contacted Candlelit International Auctions to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
