THIS IS A NO PREMIUM SALE 1. Except as otherwise stated, Shaw Galleries is the Seller of the lots featured at the auction. The contract for the sale of property is therefore made between the Seller and the Buyer (sometimes referred to herein as "You"). 2. This is an "AS IS" sale. ALL SALES ARE FINAL AND ALL PROPERTY IS SOLD "AS IS." Shaw Galleries makes no guarantees, warranties or representations, expressed or implied, with respect to the property, its visual depictions on this website, the correctness of the catalog, and statements of the authenticity of authorship, physical condition, size, quality, rarity, provenance, exhibitions, medium, material, genuineness, attribution, period, culture, source, origin, literature or historical significance of any lot sold. No statement anywhere, whether oral or written, or posting of a photograph, shall be deemed as such a guarantee, warranty or representation. 3. DESCRIPTIONS - All statements by Shaw Galleries in the catalogue entries for the property or in the condition reports or made orally or in writing elsewhere, are statements of opinion and are not to be relied upon as statements of fact. Shaw Galleries attempts to catalog and photograph every lot correctly and will attempt to point out all defects but will not be responsible or liable for the correctness of the catalog, other descriptions or visual depiction of any lot. Sizes and weights are approximate. The absence of any reference to the condition, and/or Buyer's inability to see every detail of a lot in the catalog and photographs, does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Estimates of the selling price should not be relied upon as statements that this is the price, for which the item will sell or its value for any other purpose. Neither Shaw Galleries nor the Seller is responsible for any errors and omissions in the catalogue or any supplemental material. 4. BUYER'S RESPONSIBILITIES - You, as a prospective Buyer, are responsible for personally examining or otherwise insuring satisfaction with all lots, in which You have an interest. By placing a bid, You signify that You have examined, or otherwise insured to Your satisfaction with the lot as fully as You desire; or that You have chosen not to examine, or otherwise insure Your satisfaction. If You require absolute certainty in all areas of authenticity, condition, etc., and the results of Your examination and/or other investigation leave uncertainty in Your mind, Shaw Galleries recommends You have an independent expert examine the lot for You. 5. LIMITATION OF LIABILITY/NON-DELIVERY OF PURCHASED LOTS - If a lot cannot be delivered to the Buyer due to loss, theft, breakage, other damage, or acts of God, or for other reasons, the sale will be considered canceled and Shaw Galleries shall not be held liable. 6. REFUSAL OF ADMISSION - Shaw Galleries has the right, at its discretion, to refuse admission to its premises or participation in any auction and to reject any bid. 7. SALES TAX ? Shaw Galleries is a registered business in the State of Pennsylvania, USA. All purchases by residents of Pennsylvania will be subject to 7% Pennsylvania Sales Tax unless the buyer provides Shaw Galleries with a valid Resale Certificate at the time of registration. Merchandise purchases with a Resale Permit from a state other than Pennsylvania shall be considered sold outside of Pennsylvania. Non-Resale purchases from Out of State must be shipped from Shaw Galleries by common carrier, or Pensylvania Sales Tax is applicable. 8. PAYMENT AND PASSING OF TITLE - Payment is due immediately upon close of auction. The Buyer must pay the full amount due (sale price and applicable taxes) no later than twenty (20) days following the sale. This applies even if the Buyer wishes to export the property and an export license is, or may be, required. The Buyer will not acquire the tile to the lot until all amounts due to Shaw Galleries from the Buyer have been received by Shaw Galleries in good cleared funds, even in circumstances where Shaw Galleries have released the lot to the Buyer. 9. COLLECTION OF PURCHASES - Shaw Galleries is entitled to retain the sold property until all funds due to Shaw Galleries are received in full in good and cleared funds. Subject to this, the Buyer shall collect the purchased lots within fourteen (14) calendar days of the day of sale, unless otherwise agreed between Shaw Galleries and the Buyer. Purchased lots, which are paid for but left on Shaw Galleries's premises for any reason in excess of one (1) year, are considered abandoned. In case of abandonment Shaw Galleries reserves the right to dispose of the property in a manner it sees fit and retain the proceeds. 10. PACKING, HANDLING, AND SHIPPING - Shaw Galleries will pack small lots. Larger, more difficult lots will be packed professionally (by a reputable outside company selected by Shaw Galleries) and shipped to the address You provide when You registered to bid, unless You notify Shaw Galleries that You would like to make different shipping arrangements. A separate charge will appear on Your credit card for shipping and handling. If You have purchased a large number of items and/or Your shipment requires extraordinary handling Shaw Galleries will contact You before shipping. Shaw Galleries will not be responsible for the acts or omissions of carriers or packers whether or not recommended by Shaw Galleries. Purchased lots will not be released to the carrier without payment made in full by the Buyer.
