The Following is the complete terms and conditions for which all property is offered for sale by Glamouria Fine Art International Inc. 1.All Property is sold as is, we make no guarantees, warranties or representations expressed or implied with respect to the property or correctness of the catalog or other descriptions of authenticity or of authorship, physical condition, size, quality, rarity, importance, providence, exhibition or historical relevance of the property. No statements anywhere, whether written or oral, shall be deemed such a guarantee, warranty, or representation. Prospective bidders should inspect the property before bidding to determine condition, size and whether or not it has been repaired or restored. NO refunds or credit shall be issued. 2-All lots are sold in Canada are subject to an Goods and Services Tax (GST) , Provincial sales taxes (PST) and Harmonized Sales Tax (HST) where is applicable sales tax unless a resale number is given. 3-Payment must be made on the day of the purchase. Payment can be Certified Check Cleared, Visa, Mastercard, Bank Wire Transfers, or Cashiers Check Cleared. 4-Bidders are required to register prior to sale and must use the provided bidder number if provided. 5-The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of any dispute between bidders, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer or resell the item in dispute. 6-On the fall of the auction hammer, sale will be passed to the highest bidder acknowledged by the auctioneer, subject to the fulfillment by such bidder of all the conditions set forth herein, and bidder assumed full risk and responsibility and will pay the full purchase price. Invoices are subject to audit for error and bidder is responsible for paying any balances due therein. 7-All articles are to be removed within 10 days after sale. Any item not removed will be stored by Glamouria Fine Art International Inc. Fees will be charged accordingly. 8-We are not responsible for the acts or omissions of carriers or packers of purchased lots, whether or not recommended by us. Packing or handling of purchased lots by us is at the risk of the purchaser. In no event will we be liable for damages to glass or frames regardless of cause. 9-We reserve the right to withdraw any property prior to sale. 10-This is a privately owned and operated sale. We reserve the right to refuse admission to any person. No children will be allowed at the sale. 11-If any applicable conditions herein are not complied with by the purchaser, in addition to other remedies available to us and the consignor by law, including without limitation the right to hold purchaser responsible for the total purchase price, we may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction with out reserve. 12-Glamouria Fine Art International Inc is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Glamouria Fine Art Inc or anyone else if the Internet service fails to work correctly before or during the live auction. Glamouria Fine Art International Inc will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Glamouria Fine Art International Inc reserves the right to withdraw or re-catalog items in this auction. 13-Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Glamouria Fine Art International Inc shall endeavor to describe in detail each item and any pertinent information about it. Glamouria Fine Art International Inc will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. 14- The items sold are often of considerable age and will exhibit wear, usage and damage often NOT LISTED IN THE DESCRIPTION. The absence of condition remarks in the description DOES NOT mean the item is in perfect condition. Please note that Glamouria Fine Art Inc is pleased to provide our opinion of the condition of items offered for sale upon request. This service is provided for guidance only, without legal obligation. All lots are sold AS IS and there will be NO RETURNS BASED ON CONDITION. Subsequently, if a prospective buyer has not examined the property to their satisfaction before the sale, or his/her agent has not inspected the property, Glamouria Fine Art International Inc RECOMMENDS THAT THEY NOT BID ON THE PROPERTY.
