There is 0% Buyers Premium, No In-House Shipping. Due to liability concerns we DO NOT in any circumstance ship or pack items ourselves, we will however take the items to a local UPS store where it will be packed and shipped professionally according to your specifications. Shipping is the sole responsibility of the buyer. Shipping will be arranged at the buyer's expense at reasonable rates. Purchases must be paid for first/separately and you will then be contacted by the shipper with a quote/invoice. Arrangements can be made to preview any item up for auction at our location. All lots to be sold AS IS, WHERE IS. ALL SALES FINAL. 1) Identification - All purchasers are required and shall supply Broadway Auction Service with their full name, address and telephone number. A form of picture identification is required to verify information. 2) Addition to or withdrawal from sale - The Auctioneer reserves the right to withdraw from sale any of the items listed. Whenever the best interest of the seller will be served, the auctioneer reserves the right to sell all of the items listed. 3) The auctioneer has the right at his absolute discretion to refuse any bid. The highest bidder shall be the buyer at the hammer price. 4) Dispute between bidders - If any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again or at a later date, and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. 5) Condition of items sold - Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. Broadway Auction Service shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. The auctioneer shall not be responsible for the correct description, authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold ?as is? and without recourse. 6 )Manner of payment - All lots are to be paid in full by cash, approved check or Paypal within in 10 days of auction end. Auctioneer reserves the right to hold merchandise until a buyer?s check clears and reserves the right to not accept a check. There will be a $25.00 service charge for any check returned from the bank for any reason. All items purchased on the Live Auctioneers platform must be paid for in 10 days from the date of sale, unless prior arrangements have been made with Broadway Auction Service a dispute will be filed after that period, once a dispute is filed claims to unpaid items are void and Broadway Auction Service will have full title & claim to these items in order to resell them at auction. In the event of a filed dispute the bidder will have 7 days to contact and arrange payment of winning bids before the dispute becomes permanent and the items re offered. No transfer will be recognized from one buyer to another. 7) New York Sales Tax - New York Sales Tax. Unless exempted by law purchases, will be subject to 8.25% New York Sales Tax unless the buyer provides Broadway Auction Service with a valid Resale Certificate at the time of registration. Identification such as a business card is required. There is No in house shipping. All purchases will be shipped by UPS-New York Sales Tax is applicable. 8) All measurements and sizes - are approximate. 9) Records - The record of sale kept by the auctioneer and clerk will be taken as final in the event of any dispute. 10) All lots - to be sold AS IS, WHERE IS. ALL SALES FINAL. 11) All bids placed and all payments made must be in U.S. dollars drawn on a U.S.Bank unless payment in U.S. dollars wired from a foreign bank has been pre-arranged. Internet bills may be paid via PayPal with PayPal funds or credit card. 12) If bidding by Internet, the purchaser shall have consented to the exclusive jurisdiction of The State of New York. 13) There is no In House Shipping. We are not responsible for the act or omissions of carriers or packers of purchased lots, whether or not recommended by us. Packing and handling of purchased lots by us or by someone else is at the entire risk of the purchaser. 14) Title to all merchandise shall pass to the highest bidder and the fall of the liveauctioneers "hammer".
