Terms & Conditions: · All items are sold “as is, where is” with all faults, imperfections and errors of description. When faults are noticed during cataloging we make note of them in the description. However, we do not imply there are no other faults, and the buyers must satisfy themselves as to all faults, cracks, chips, wear, imperfections, restorations, etc. All sizes and weights are approximate. · No warranties are made as to age, use, value, cost or condition of any item. Descriptions and provenance are stated in our best opinion or from sources deemed reliable, but are not guaranteed unless otherwise stated. No refunds or adjustments will be made. · Complete payment is required day of auction or upon receipt of notification of a successful bid. · Payment for all purchases must be made day of sale. We gladly accept, CASH, BANK CHECK, VISA, MASTERCARD & DISCOVER, MONEY ORDER, PAYPAL. PERSONAL CHECKS ACCEPTED FROM LOCAL NC RESIDENTS ONLY. · Paid items may be removed from the auction center. Please note that online purchasers who wish to pick up their items shall not do so until the Tuesday following the day of auction. After two (2) weeks, any items remaining at the auction center will be placed in storage. Fee for storage is $10 per week per item. · Lilly Auction will have no responsibility for an item once it is sold. Title will pass to the highest bidder upon the fall of the auctioneer’s hammer and thereafter the property is at the purchaser’s sold risk and responsibility. · Packaging, shipping & insurance is the responsibility of the buyer. Lilly Auction will facilitate and ship small items and multiple items of similar size and type will be packed together. For large / oversized items and furniture we suggest contacting Craters & Freighters at 704-372-0640. Please allow 2 weeks from receipt of payment for shipping. · 7% North Carolina sales tax will be applied to in-state buyers unless resale number is on file in our office. · A 15% Buyer’s Premium is added to each hammer price. · Due to uncertainties of bidding, a lot may sell to the audience for the same amount as an internet bidder. The auctioneer’s decision shall be binding and final. · The record of sale, kept by the auctioneer and clerk, will be taken as absolute and final in all disputes. · Lilly’s will not be held responsible for error or failure to execute bid(s). Absentee bids must be in writing and a fifty dollar minimum bid is required per item. Phone bidding is an available service and must be arranged in advance with our staff. · All auction inquiries must be received 24 hours prior to the start of the auction. The deadline for email inquiries is May 27, 2004 at 1 pm EST. · Purchasers may inspect the merchandise and are urged to do so. The Auctioneer makes no warranty as to condition and shall not be responsible for any defects in any lot. All good are exposed to for Public Exhibition and for Internet buyers condition is described. All goods are sold as is and without recourse. · 10 Day Guarantee Terms: All items in the catalog are sold as described. All returns must be made within the 10 days following the auction. After the 10 day period all items are considered as is where is, without recourse. Refunds in cash or credit shall be for the purchase price only; shipping costs excluded. Any announcements and addendums prior to the auction take precedence over the description in the catalog. The guarantee is only valid to the original buyer. The item(s) must be in the same condition as when purchased. Discrepancies of description shall be decided by a mutually agreed upon expert in the field. The authentication must be in writing and is at the expense of the purchaser. Bidding at a Catalogued Auction indicates that you have read and accepted these conditions. · Lilly Auction will have no responsibility for an item once it is sold. Large items will be marked and stored in back, small items will be handed directly to the buyer. Title will pass to the highest bidder upon the fall of the auctioneer’s hammer and thereafter the property is at the purchaser’s sole risk and responsibility. · The highest bidder to be the buyer. If any dispute arises between bidders, the item in dispute shall, at the discretion of the auctioneer, either be re-offered for sale or sold as stated. In any event, the auctioneer’s decision will be final. If a dispute arises after the auction, our sales record will be deemed final. · If Lilly’s is prevented by fire, theft or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum total actually paid by the purchaser. · Please Note: For the protection of both buyer and seller, all gallery sales are video and audio recorded. · All statements made by the auctioneer prior to the auction of any items take precedence over written material and any prior verbal statements.
