Terms & Conditions of Sale These terms and conditions supersede all previous announcements, advertisements, and published information, however distributed, except for any announcements made by Auctioneer at the auction, which will take precedence and be controlling in all instances. Registration: You must register to bid in this sale. Identification in the form of a driver’s license or comparable documentation is required. Payment: Balance of payment due in full at the conclusion of the auction by PayPal, Visa, or MasterCard. Buyer’s Premium: A 13.% buyer’s premium is in effect for all online transactions. That means that a surcharge of 13.5% will be added to highest bid for that item. Bidders are responsible for payment in full of all purchases before removal. Warranty: All items sold “As-is, Where-is,” with all faults, if any. The information contained herein has been obtained from sources believed to be reasonably reliable. The auctioneer believes that each item has been carefully and accurately described, however, the auctioneer and owner make no warranties (either expressed or implied) or guarantees the accuracy of the information in this offering, or to the merchantability, correctness, description, fitness or condition of the items. Purchaser has examined the sale items and their locations and has performed such tests, as he/she deems necessary and appropriate. Ownership: Immediately upon knockdown, buyers are responsible for the security, payment, and removal of items at their own risk and expense. Condition: Any comments as to the condition of the assets are illustrative or obvious and are not exclusive of any other condition, problems or defects. Quantities: All counts are approximations based on actual counts, except where noted. The auction catalog is subject to additions and/or deletions up to, including and through bid close date. Auctioneer and seller reserve the right to group, reduce, add, or delete lots. Removal: No merchandise may be removed while the sale is in progress. No item may be removed prior to payment in full. Removal is at the risk and expense of the buyer. Items not removed by WEDNESDAY JUNE 21, 2006 4PM will be considered abandoned unless prior arrangements have been made with the auctioneer or the owners. American reserves the right to require insurance certificate for removal of large item. Bidders are responsible for their own removal. **ANYONE PICKING UP MERCHANDISE ON YOUR BEHALF MUST HAVE YOUR ORIGINAL SALES RECEIPT DUPLICATE SALES RECEIPTS FOR PICKUP CAN ONLY BE OBTAINED FROM THE AUCTIONEER. NO EXCEPTION! Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Assets will be released upon presentation of a paid receipt. Please insure that movers or anyone picking up items on your behalf have your paid receipt at the auction location. Sales Tax: All sales are subject to state and/or local sales tax unless a signed exemption form is presented for our record at the time of purchase. Sale items and title to the sale items are transferred to the purchaser without recourse or regress to the auctioneer, secured creditor, or landlord. By Bidding in this Auction Sale, you agree to abide by these terms as well as any others announced by the auctioneers. Bidders hereby indemnify and hold harmless the seller, secured creditor, auctioneer, and landlord, from all damages, claims or liabilities from any injuries caused to persons or property during inspection or during removal or from claims pertaining to the fitness or use of any items that has been purchased at auction. RULES FOR ABSENTEE and INTERNET BIDS, understanding that many bidders will find it difficult to travel to each of our Auctions, or to remain for the entire Auction, we have implemented an Internet Bid Policy that we believe is easy to understand and fair to everyone. It is the bidders responsibility to Inspect For Condition: It is your responsibility to personally inspect any items that interest you for condition. If you are unable to personally inspect those items, we highly recommend that you have a third party or proxy whose opinion you trust inspect the items for you and report back to you with their opinion. American Auctions & Appraisals, Inc., nor any of its staff, will be held responsible for any errors in the execution of your online bids, or for the possible failure to execute any of your online Bids. DSL or Cable Modem vs. Dial-Up: You should recognize that DSL or Cable Modem can be ten times faster than the dial-up service and occasionally dial-up modem bidders may lose out on bids altogether due to the slowness of their connection. eBay LIVE AUCTIONS are DIFFERENT from Regular eBay AUCTIONS. We are a Live Auction…selling between 500-1000+ lots per Auction…with items selling to Live Auction Attendees, Internet & eBay Live Bidders, Absentee Bidders, and Telephone Bidders. American will contact you within hours after the conclusion of the Auction. We will send you an Invoice for the total amount due as quickly as possible. SHIPPING - You should recognize that we are a Live Auction Company and not a packaging/shipping company. Once your Auction balance is settled, YOU must contact and coordinate shipping. YOU must contact them directly and you can arrange your own shipping instructions and payment with them. Please consider shipping costs prior to bidding…not after you bid.
