Upton, of Batavia, New York, graduated from the United States Military Academy at West Point in May 1861. Commissioned as a 1st Lieutenant in the 5th U.S. Artillery he was wounded at the Battle of First Bull Run. He commanded his artillery battery through the Peninsula Campaign and Seven Days Battles. In the Maryland Campaign, including the battles at Crampton's Gap at South Mountain and at the Battle of Antietam, he commanded the artillery brigade for the 1st Division, VI Corps. In October 1862, Upton was appointed Colonel if the 121st New York Volunteer Infantry, commanding the regiment at Fredericksburg and Gettysburg. In the Overland Campaign he led his brigade in the Battle of the Wilderness. At the Battle of Spotsylvania Court House, Upton made what was perhaps his greatest contribution of the war when he devised a new tactic for attacking the Confederate line. Instead of attacking along a broad front, he massed 12 regiments and attacked in a column. The soldiers in the attacking column did not pause to fire their weapons. The column broke the Confederate line at the Mule Shoe salient. For his efforts at Winchester, Upton was promoted by brevet to Major General of Volunteers.
