The following, as amended by any posted notices or announcements during the sale, constitutes the entire terms and conditions on which item listed in the catalog shall be offered for sale or sold by BIDHAUS LLC (BIDHAUS). PLEASE READ THIS ENTIRE AGREEMENT. Terms and Conditions of Sale Please be advised that by placing a bid, you are entering into a legally binding contract with BIDHAUS. If you are the successful and winning bidder, you shall have a legal obligation to purchase the item(s) bid from BIDHAUS. Place a bid only if you are serious about buying the item. Any questions before bidding should be resolved by contacting BIDHAUS. BIDHAUS reserves the right to withdraw or combine any lots listed in the auction at any time with no liability. Furthermore, BIDHAUS reserves the right to cancel and/or refund the full purchase price plus any buyer premiums and shipping charges should they feel the item(s) not successfully pass and meet their quality control standards prior to shipping. In the event this occurs, or if the item was sold prior to receipt of payment by bidder, BIDHAUS may provide the winning bidder with the same or similar item, in equal or better condition, at no additional charge to bidder. The successful bidder is the highest bidder acknowledged by the Auctioneer. BIDHAUS and its Auctioneers will have final discretion in determining the successful bidder and in resolving any disputes between bidders. BIDHAUS reserves the right to cancel any transaction post auction should the item no longer be available or in the event said item was sold on another online platform. In these instances, bidder will receive a full refund on cancelled item. If any dispute arises after the sale, the BIDHAUS sale record shall be conclusive. Successful bidders must pay for the entire invoice before said items are removed from inventory or online auction platform. Buyer?s Premium Each lot sold at the auction is subject to a twenty-five percent (25%) buyer?s premium. In addition, bidders may be charged sales tax per state and federal tax laws.. Payment Payments for winning bids may be made with Visa, MasterCard, Discover, AMEX, Bitcoin and bank wire transfers. All payments made via credit card are subject to processing fees whereas payments made via wire transfer will not incur such fees. All items must be paid for within forty-eight (48) hours from the date of auction. BIDHAUS reserves the right to delay shipment of items until all funds have fully cleared. Any payments due to BIDHAUS exceeding $2,000.00 or any new bidders lacking sufficient successful auction payment history, may be required to wire funds at the sole discretion of BIDAHUS. Please note, bidders with credit card on file may be auto-charged 4 days after an invoice has been sent. Shipping, Handling and Insurance BIDHAUS provides handling, packing and shipping services at the expense of the Buyer. All items will be shipped within twenty-one (21) days of receipt and clearance of payment. An ESTIMATED SHIPPING and HANDLING AMOUNT will be included in the auction invoice after the sale. All U.S. domestic shipments will be insured at the total bid amount contained in the shipment at the sole discretion of BIDHAUS (other add-on charges are not covered by insurance). We pay for insurance services at our own expense as a security for both our Bidders and BIDHAUS. An Adult Signature is required upon delivery of all Bidhaus items. Large, heavy, fragile or otherwise unusual items will incur additional charges. We mainly use USPS, UPS or FedEx Ground Shipping on domestic shipments, which may take three (3) to seven (7) business days. Under special circumstances, BIDHAUS may ship items using UPS or FedEx Express Mail, private carriers or pack and ship enterprises, the cost of which shall be charged to the Bidder. BIDHAUS will not use lower classes of mail to ship sold merchandise due to increased risk of loss. Special shipping and handling requests may be accommodated on a limited basis at BIDHAUS sole discretion and may incur additional handling charges. All costs charged to a Bidder's original invoice are estimates and BIDHAUS reserves the right to charge additional amounts if such estimates are exceeded. By acknowledging this Agreement, Buyer agrees to any additional charges as may be necessary to accommodate special shipping and handling requests. Shipping and handling charges to Hawaii, Alaska, the U.S. Territories and Foreign Countries are higher and often require registry or express mail. The shipping carriers may also limit insurance coverage to foreign locations. BIDHAUS will allow pickups on a case by case basis at its sole discretion. International Shipping BIDHAUS will ship items to foreign locations using the same classes of mail and additional postal services that it uses to ship to U.S. locations, to the extent that such services are available. Please be advised that insurance coverage may be limited or unavailable for those locations. To the extent foreign bidders are aware of alternative shipping arrangements, which may be desired to increase insurance coverage, we advise them to notify BIDHAUS of such options. BIDHAUS shall not be liable for any shortfall of insurance either on foreign shipments or on the non-coverage of additional invoice charges exceeding bid amounts. BUYERS ARE RESPONSIBLE FOR ALL INTERNATIONAL CUSTOMS DUTIES AND/OR TAXES. We are not told in advance of what a given country may charge for customs duties and/or taxes. Condition We have tried to accurately describe every item. Condition and substantial defects are noted or photographed, minor defects or smells may not be mentioned (these are to be expected in pre-owned or vintage items). Please review images carefully as all items are sold AS IS. Keep in mind that on certain monitors, photos and light may depict slight color variations. Unless specified in the lot description, item may not come with box, papers, dust-bags, or authenticity card/certificates. Authenticity BIDHAUS guarantees all items to be 100% authentic. As an additional option, for most handbags, BIDHAUS can provide a 3rd party authentication certificate through Entrupy, one of the most trusted authentication services in the industry. Bidhaus reserves the right to charge up to $50 for this service. This Certification of Authenticity does not imply that the item will be certified by any other rival authentication companies. The accompanied Entrupy certification is the only certification the auction company can provide unless specified otherwise. Returns All items are sold AS IS, WHERE IS, with all faults, and ALL SALES ARE FINAL. Returns may only be made with written authorization of BIDHAUS, at BIDHAUS sole discretion. To request a return, you must provide a written request fully explaining the basis for the return no later than three (3) days after your receipt of the lot. Under no circumstances will any amounts other than the winning bid amount be refunded. A restocking fee of 20% of the full invoice amount may apply. All authorized returns must be received in the same condition as when originally shipped to Buyer, or they will be returned to Buyer at Buyer's cost. Any unauthorized returns will be refused. Refusal to accept merchandise delivered by BIDHAUS to the bidder constitutes an unauthorized return in direct violation of these general terms and conditions. Liability and Disclaimer BIDHAUS and its Vendors disclaim any warranties, express or implied, including but not limited to the Implied Warranty of Merchantability or Fitness for any particular purpose. No warranties are made that the item offered for sale is what it is described to be by the Auctioneer or the auction. Neither BIDHAUS, nor its Vendors will be held responsible for any descriptions of the rarity, quality, condition, size, importance, or provenance of the item. While BIDHAUS representatives, to the best of their ability, describe the items for sale, any statement, whether oral or written, by the Auctioneer or by any BIDHAUS representative are mere opinions and shall not be deemed a warranty or representation regarding the item offered for sale. Any low or high estimate provided in the auction catalogue or by the Auctioneer prior to, or during the live auction does not constitute an appraisal and does not represent a resale value. Estimates are provided merely as an estimation of similar items in new, retail conditions and is meant to juxtapose the sale of new items versus purchasing second hand. The bidder is responsible for determining the age, size, condition and value of the item before bidding.
