Conditions of Sale *Notice: The English version of the Terms and Conditions of Sale is provided for courtesy purposes only. In case of any contrast with the Italian version, the latter will prevail. **You can find the italian version of the terms and conditions of sale below the english one TERMS AND CONDITIONS OF SALE 1. DEFINITIONS (a) Buyer: the natural or legal person making the highest bid accepted by the auctioneer at an auction or purchasing the lot through private treaty; (b) Total Amount Due: the amount due for the purchase of the lot, in addition to the Buyer's Premium and the Expenses; (c) Urbani Code: Legislative Decree 42 of 22 January 2004; (d) Buyer's Premium: the consideration due to Art-Rite by the Buyer in connection with the purchase of the lot and calculated in percentage of the Hammer Price, on the basis of the percentage value indicated in the auction catalogue or the Terms and Conditions of Sale, in addition to any other amount due to Art-Rite by the Buyer in connection with VAT or any equivalent tax; (e) Counterfeit: according to Art-Rite's reasonable opinion, an imitation of a lot offered for sale, not described as such in the auction catalogue, created for the purpose of being deceptive as to its authorship, authenticity, provenance, attribution, origin, source, date, age, period, and that, at the date of sale, had a lower value than the one it would have had if the lot had been corresponding to the description contained in the auction catalogue. A lot that has been restored or undergone modifications of any kind (including repainting or overpainting) does not constitute a counterfeit; (f) Data: personal data, as defined by Art. 4, 1st Paragraph, letter b) of Legislative Decree 196 of 30 June 2003 ("Personal Data Protection Code"), provided also verbally and/or over the telephone by the Buyer, including those collected in connection with the auction or in any way related to the auction; (g) Art-Rite: Art-Rite S.r.l, with registered offices in Milan, Via Giovanni Ventura n. 5 (20134). Art-Rite acts as agent of the Seller; (h) Price: the price at which the lot is sold to the Buyer by the auctioneer at an auction or, in case of sale through private treaty, the price agreed upon by Art-Rite and the Buyer, net of the Buyer's Premium; (i) Reserve: the minimum (confidential) price at which the Seller has agreed with Art-Rite to sell the lot; (l) Website: www.Art-Rite.it; (m) Expenses: in connection with the purchase of a lot, all the expenses due to Art-Rite by the Buyer, including (but not limited to) the following: taxes of any kind, packaging and shipment costs, expenses related to the collection of any sums due by a defaulting Buyer, expenses - if any - incurred for the reproduction of the lot, its estimate and/or authentication, the Artist's Resale Right, that the Buyer agrees to bear and that should be paid by the seller under Art. 152, 1st Paragraph, Law 633 of 22 April 1941; (n) Seller: the natural or legal person who is the owner of the lot offered for sale at an auction or by private treaty by Art-Rite, as an agent of the same. 2. ART-RITE'S OBLIGATIONS TO THE BUYER 2.1 Art-Rite acts as an agent of the Seller, except in the event that the former is the owner of a lot, either in part or in full. 2.2 Lots are sold with all defects, flaws and description errors. The pictures contained in the catalogues are provided for the sole purpose of identifying the lot concerned. The Buyer undertakes to examine the lot before the purchase, in order to check if the same is compliant with the catalogue description, and, if the case may be, to request the opinion of an independent expert or scholar, in order to verify its authenticity, provenance, attribution, origin, date, age, period, cultural origin or source, and condition. 3. ART-RITE'S AND THE SELLER'S LIABILITY TO THE BUYER 3.1 Any representations provided by Art-Rite, either verbally or in writing, including those contained in the catalogue, reports, comments or evaluations concerning any characteristic of a lot, such as authorship, authenticity, provenance, attribution, origin, date, age, period, cultural origin, source, its quality, including its price or value, exclusively reflect opinions, and can be reviewed, and also changed, by Art-Rite, before the lot is offered for sale. 3.2 Art-Rite and its employees, collaborators, directors or consultants cannot be held liable for any mistakes or omissions contained in said representations. 3.3 Without prejudice to what set forth by clauses 3.1 and 3.2, Art-Rite's liability to the Buyers in connection with the purchase of a lot by the latter is limited to the Hammer Price and the Buyer's Premium paid to Art-Rite by the same. Except for the case of gross negligence or misconduct, Art-Rite or its employees, collaborators, directors or consultants may not be held liable for acts or omissions concerning the preparation or conduction of the auction or any issue relating to the sale of the lots. 4. SALES BY AUCTION 4.1 The auction is regulated by the Terms and Conditions of Sale and the Terms and Conditions of Mandate. The Terms and Conditions of Sale can be amended with a saleroom notice posted in the auction room or an announcement made by the auctioneer before the auction begins. In the event that a person, who has been given the possibility of making a bid in connection with a lot, has a direct or indirect interest in the same, such as a beneficiary or a will executor that has sold the lot, a co-owner of the same or any other parties having provided a guarantee in relation to the lot, Art-Rite will include such information in the catalogue. Estimates published in the catalogue for potential buyers are approximate and lots can reach prices that are both higher and lower than the indicated estimates. It is always advisable to consult with Art-Rite before an auction, as estimates may be subject to changes. Estimates published in the auction catalogue are not inclusive of the Buyer's Premium and VAT. Art-Rite may prohibit anyone from participating in some auctions. The auctioneer, in conducting the auction, starts from a bid that the same deems adequate, in consideration of the value of the lot and of competing bids. The auctioneer can make consecutive bids or in reply to other bids, in the Seller's interest, until the Reserve is reached. 4.2 Written bids are valid only if received by Art-Rite at least 24 hours before the beginning of the auction and sufficiently clear and complete, notably with respect to the lot and the price at which the bidder intends to purchase it. In the event that Art-Rite receives multiple written bids of the same amount on a specific lot, and they are the highest bids made on such lot, the same will be allotted to the bidder whose bid has been received first by Art-Rite. If you intend to make written bids, please fill in the "Bid Form" annexed to the auction catalogue and send it off with the documentation indicated therein 4.3 Bids made over the telephone are valid if confirmed in writing before the auction. Art-Rite reserves the right to record bids made over the telephone and declares that it may not be held liable, at any title, vis-à-vis auction attendees in connection with problems or disruptions affecting the phone service (e.g., interruption or suspension of the connection). 4.4. Art-Rite will indicate on the Website (at least 24 hours before the date of the auction) and/or in the catalogue the auctions where it will be possible to make bids online as well. If you wish to participate in an auction through the Internet, you will be able to make your bids in real time. Participation in an auction through the Internet is subject to your registration with the Website or with other Websites through which the online bidding service will be provided and the subsequent signing up for the auction at least 24 hours before the auction begins. Once granted access to the Website as a registered user, you will be held liable for any activities carried out on the Website by using your access credentials. You will promptly inform Art-Rite of any unlawful use of your password or in case of loss of the same. In the latter event, Art-Rite will provide you with a new password granting access to the Website, and you will no longer be able to use the previous password for access to the Website or participation in auctions. Art-Rite does not guarantee that the Website is always operational and that there will be no disruptions when you participate in an auction, or/and that the Website and the relevant server is free from viruses or any other hazardous or potentially hazardous materials. Consequently, except in case of willful misconduct or gross negligence, Art-Rite may not be held liable for any technical problems arising when the auction is under way (e.g. slow browsing speed or disruptions in the server managing participation in the auction through the Internet). Art-Rite will not be held liable for any damage or inconvenience suffered as a consequence of any improper use of the Website in accordance with this information and the conditions of use of the Website. You will refrain from using any kind of software or tool affecting or interfering (also only potentially) with the conduct of the auction, and undertake to use the Website and any related applications in good faith and in a proper manner. 4.5. The auctioneer will accept the highest bid by the fall of the hammer, which will be the Hammer Price, and consequently the conclusion of the sale contract between the Seller and the Buyer. 4.6 The auctioneer may, at its sole discretion and at any time in the course of the auction: withdraw a lot from the auction; review a sale offer relating to a lot, whenever the same may deem that it contains mistakes and/or could give rise to disputes; and/or adopt any measures that the same deems adequate to the circumstances at hand. 4.7 At some auctions, a video screen may be operated. Art-Rite will not be held liable for either the correspondence to the original of the image displayed on the screen and any malfunctions of the video screen. 4.8 Art-Rite represents that the lot can be declared an object of cultural interest by the Italian Ministry of Cultural Heritage and Activities and Tourism under Art. 13 of the Urbani Code. In the aforesaid case, or in the event that a procedure has been undertaken in order to declare the lot an object of cultural interest under Art. 14 of the Urbani Code, Art-Rite will announce said circumstance before the sale. Should the lot be declared of cultural interest, the Seller will notify the sale to the competent Ministry under Art. 59 of the Urbani Code. The sale will be subjected to the condition precedent that the Ministry does not exercise its pre-emption right within sixty days as of the date of receipt of the relevant notice, or within one hundred and eighty days under Art. 61, 2nd Paragraph, of the Urbani Code. In the period when the pre-emption right may be exercised, the lot cannot be delivered to the Buyer in accordance with Art. 61 of the Urbani Code. 4.9 The Reserve cannot exceed the Minimum Pre-sale Estimate announced or published by Art-Rite, except in the event that the Reserve is expressed in a currency other than Euro, and significant fluctuations have occurred from the date at which the Reserve was agreed and the date of the auction. In said circumstance, unless otherwise agreed between Art-Rite and the Seller, the Reserve will be changed into the corresponding euros amount, calculated on the basis of the official exchange rate of the day immediately preceding that of the auction. 5. PAYMENT 5.1 The Buyer will pay the Total Amount Due to Art-Rite immediately after the end of the auction. The Buyer's Premium is in the percentage of 25.00 % of the Hammer Price of the lot, up to a maximum amount of Euro 3,000.00. In connection with any portion of the Hammer Price in excess of Euro 3,000.00, the Buyer's Premium is in the percentage of 23.00%, up to a maximum amount of Euro 500,000.00. With respect to any portions of the Hammer Price in excess of Euros 500,000.00, the Buyer's Premium is in the percentage of 18.00%. The aforesaid percentages are inclusive of VAT or any equivalent tax. In the event that, with reference to a specific lot, the percentages contained in the auction catalogue are different from those indicated herein with respect to the Buyer's Premium, the percentages contained in the catalogue will prevail. A Value Added Tax (VAT) may be applied to the Hammer Price and/or the Buyer's Premium. Referral is made to the information concerning VAT contained in the "Symbols" section below. In order to harmonize fiscal procedures between EU Member States, on 1 January 2001 new regulations came into force in Italy, and the margin scheme was also extended to auction houses. Under Art. 45 of Law No. 342 of 21 November 2000, said scheme also applies to sales made under commission contracts entered into with: (a) private individuals; (b) entities subject to VAT that have subjected the transaction to the margin scheme; (c) entities that could not detract said tax pursuant to Art. 19, 19-bis, and 19-bis2 of Presidential Decree 633/72 (i.e. the sale was made in exemption regime under Art. 10, 27-quinquies); (d) entities benefitting from the exemption regime granted to small enterprises in their own country. By virtue of the specific legislation in force, in the aforesaid cases, Art-Rite will apply the relevant VAT, if any, or the equivalent tax, whenever applicable. 5.2 The ownership of the lot will be transferred from the Seller to the Buyer only upon payment by the Buyer of the Total Amount Due. If you are the highest bidder for a lot, you shall make the payment immediately after the auction, using the following methods: cash, bank draft, cheque, Cash Card or Credit Card (American Express, Visa or Mastercard), Paypal. Art-Rite can accept single or multiple payments in cash only for amounts up to Euro 2,999.99. In case of bank transfer, the bank details are the following: IBAN Code: IT53-K-05034-11301-000000011412; SWIFT Code: BAPPIT21680. 5.3 In case of non-payment or late payment, in full or in part, of the Total Amount Due, Art-Rite may, at its discretion, enforce the payment or terminate the contract under Art. 1454 of the Italian Civil Code, being it understood that the period available for the payment performance agreed therein is of five (5) days, in any case without prejudice to Art-Rite's right to claim damages and sell the lot on behalf and at the expenses of the Buyer, pursuant to Art. 1515 of the Italian Civil Code. 5.4 In case of non-payment or late payment by the Buyer, in full or in part, of the Total Amount Due, Art-Rite may attribute any payment made to Art-Rite by the Buyer to the Buyer's debt constituted by the Total Amount Due, or any other sum due to Art-Rite by the Buyer and derived from other contractual relations. 5.5 In case of delay in the payment of the Total Amount Due for a period of over five (5) business days as from the auction, Art-Rite will store the lot in its own premises or elsewhere at the Buyer's risk and expenses. Again in case of delay in payment for a period longer than as indicated above, the Buyer will pay interest on arrears to Art-Rite at the 3-month Euribor rate set forth by law plus 2%, without prejudice to Art-Rite's right to claim damages for further damages suffered. The lot will be delivered to the Buyer only after the latter has paid the Total Amount Due, all storage and shipment costs and any other expenses incurred. 5.6 In case of non-payment or late payment, Art-Rite may reject any bids made by the Buyer or a representative of the same in the course of following auctions or request that the Buyer lodges a sum in cash as security before accepting his bids. 5.7 Art-Rite may offset any amounts due to the Buyer, at any title, against any sums due by the Buyer to the same at any title. 6. DELIVERY AND COLLECTION OF THE LOT 6.1 The lot will be delivered to the Buyer at the expenses of the same no later than (5) business days of the date of the sale. The lot will be delivered to the Buyer (or a person duly authorised by the same) only after Art-Rite has received the Total Amount Due. 7. TRANSFER OF RISK 7.1 Any risk relating to a purchased lot is transferred to the Buyer whenever is the earliest of the following dates: (i) when the Buyer receives the purchased lot; or (ii) when the Buyer pays the Total Amount Due to the Buyer, or (iii) the fifth (5) business day following the sale. 7.2 The Buyer will be indemnified of any loss or damage occurring to the lot after the sale but before risk is transferred, but said indemnity cannot exceed the lot Hammer Price, along with the Buyer's Premium received by Art-Rite. Except in case of willful misconduct or gross negligence, Art-Rite may not be held liable for the loss or damage to the frame or the glass containing and/or covering prints, paintings or other artworks, unless the frame or glass constitute the lot sold at auction. In no circumstance may Art-Rite be held liable in case of loss or damage due to any work carried out by independent experts designated by Art-Rite with the Seller's consent, or the loss or damage caused or originated, directly or indirectly, from: (i) changes in humidity or temperature; (ii) normal wear and tear or gradual deterioration due to operations on the lots and/or hidden faults and defects (including woodworms); (iii) improper treatment; (iv) war, nuclear fission, radioactive contamination, chemical, biochemical or electromagnetic weapons; (v) acts of terrorism. 7.3 The packaging and shipment of the lot to the Buyer are made entirely at the risk and expenses of the same, and under no circumstances will Art-Rite be held liable for any actions or omissions of packaging workers or carriers. 8. EXPORTATION FROM THE ITALIAN REPUBLIC 8.1 The export of artwork outside the territory of Italy is subject to the provisions of Legislative Decree No. 42 of 22 January 2004. The export of artworks outside the European Union is subject to Regulation EEC 116/2009 of 18 December 2008 and Commission Implementing Regulation (EU) 1081/2012 of 9 November 2012. The exportation of a lot outside the territory of the Italian Republic may be subject to authorization. Obtaining the above-indicated authorization is the responsibility of the Buyer. In case of non-issuance or delay in the issuance of the authorization (e.g., certificate of free circulation and/or export license), said circumstance will not constitute a reason for termination or cancellation of the sale, nor justification of late payment of the Total Amount Due by the Buyer. 9. APPLICABLE LAW AND JURISDICTION 9.1 These Terms and Conditions of Sale are regulated by the Italian law. The Buyer agrees that any dispute that may arise in connection with the application, construction and performance of these Terms and Conditions of Sale will be subject to the exclusive competence of the Court of Milan. 10. PERSONAL DATA PROTECTION 10.1 Pursuant to Art. 13 of Legislative Decree 196 of 30 June 2003 ("Personal Data Protection Code"), Art-Rite informs you that the Data provided by you will be processed by the same mainly through electronic, automatic and/or video-recording means (using modalities and devices suitable to ensure the security and confidentiality of the Data) for the following purposes: (a) in connection with the fulfilment of its obligations; (b) in order to manage the relationship with sellers and buyers (such as, for example, the management of sales proceeds, invoices and shipping operations); (c) any checks and evaluations of auction sales report and the risks related to the same; (d) the fulfilment of tax, accounting and legal liabilities and/or orders issued by public bodies, and (e) shipment of promotional and informational materials by Art-Rite using automated means, such as by email, facsimile, text messages or MMS. 10.2 The provision of Data for the purposes under Art. 10.1, letters (a) - (d) included is optional. However, in case of refusal, the participation in the auction or the fulfilment of Art-Rite's obligation will be impossible. 10.3 The consent to the processing of Data for the purposes under Art. 10.1 letter (e) is optional. However, in case of refusal, it will be impossible to receive promotional and informational materials from Art-Rite through automated means, such as by email, facsimile, text messages or MMS. 10.4 The Data will be processed by Art-Rite's employees or consultants as data processors or subjects in charge of data processing. 10.5 Your Data may also be communicated to: (a) any entity (including Public Authorities) having access to personal data by virtue of statutory or administrative provisions; (b) companies or third parties in charge of printing, enveloping, shipment and/or delivery services in connection with the lots purchased; (c) post offices, couriers or carriers in charge of delivering the lots; (d) companies, consultants or professionals, if any, in charge of the installation, maintenance, updating and in general the management of Art-Rite's hardware and software, or of which Art-Rite avails itself, including the Website; (e) companies or internet providers in charge of sending informational or promotional documentation and/or materials; (f) companies in charge of processing and/or shipping promotional and informational materials on behalf of Art-Rite; (g) all public and/or private entities, natural and/or legal persons (legal, administrative and fiscal consulting firms, Courts, Chambers of Commerce, Employment Chambers and Offices, etc.), if such disclosure is necessary or functional to the due performance of Art-Rite's obligations. Your Data will not be disclosed, except in anonymous and aggregate form, for statistical or research purposes. 10.6 The Data Controller is Art-Rite S.r.l., with offices in Milan, via Giovanni Ventura, 5 (20134) Italy, to which any requests or demands in connection with the processing of Data may be made. 10.7 The Data will be stored exclusively for the time required to ensure the proper fulfilment of Art-Rite's obligations, and in any case only for the period set forth by law. 10.8 Under Art. 7 of the Personal Data Protection Code, you have the right, inter alia, to the following, : (a) obtain confirmation of the existence of Data concerning you and obtain their communication in an intelligible way; (b) obtain, through the effort of the data controller or data processor(s): - information on the source of the Data, the purposes and modalities of processing, the logic behind their possible electronic processing; - identification details concerning the data controller and the data processor(s), and the representative, if any, designated by a foreign subject to the processing of the Data in Italy; - information on the entities or categories of entities to whom the Data may be transferred or that may access them in their capacity as designated country representatives in Italy, data processors or subjects in charge of data processing; (c ) obtain: -the updating, rectification or integration of your Data; - the removal, anynomisation or blocking of Data processed in violation of the law, including those which must be stored in connection with the purposes for which they have been collected or subsequently processed; - evidence that those who have received the Data or to whom the same are disclosed, including the relevant content, have been informed of the operations under the paragraphs above, except whenever such obligation is impossible to fulfill or requires the use of means that are clearly disproportionate in comparison to the right protected; (d) object, in full or in part: - for legitimate reasons to the processing of your personal Data, even if relevant for the purposes for which they have been collected; - to the processing of your personal Data, for promotional purposes, the shipment of advertising materials, direct sales, or marketing research studies or promotional communications. ARTIST'S RESALE RIGHTS 11.1 On 9 April 2006, Legislative Decree 118 of 13 February 2006 implementing Directive 2001/84/EC entered into force, setting forth the right, for authors of artworks and manuscripts and their relevant assignees, to receive a consideration on the price of every sale of the original following the first one (i.e. the "Artist's Resale Right"). The "Artist's Resale Right" is due only if the sale price is not lower than Euro 3,000.00. The same is calculated as follows: (i) 4% in connection with the portion of price included between Euro 0.00 and 50,000.00; (ii) 3% in connection with the portion of price included between Euro 50,000.01 and 200,000.00; (iii) 1% in connection with the portion of price included between Euro 200,000.01 and 350,000.00; (iv) 0.5% in connection with the portion of price included between Euro 350,000.01 and 500,000.00; (v) 0.25% in connection with the portion of price in excess of Euro 500,000.00. Art-Rite, being an auction house, is required to pay the "Artist's Resale Right" to the Italian Authors' and Publishers' Association [Società italiana degli autori ed editori (S.I.A.E.)]. With reference to each lot, the "Artist's Resale Right" shall be no more than Euros 12,500. In addition to the Hammer Price, the Buyer's Premium and other Expenses, the Buyer undertakes to pay the "Artist's Resale Right", that the seller would be required to pay under Art. 152, 1st Paragraph, of Law 633 of 22 April 1941. 12. SYMBOLS The following list contains an explanation of the symbols used in the auction catalogue. o Minimum Guaranteed Price In the event of a lot marked with this symbol, the Seller has been guaranteed a minimum price in connection with one or more auctions. ? Lots owned by Art-Rite In case of lots marked with this symbol, the property of the same, in part or in full, belongs to Art-Rite. SR Without Reserve If the lots contained in the catalogue are not marked with this symbol, they are subject to a sale with reserve. In the event that the lot is sold without reserve, it will be marked with this symbol. ® Artist's Resale Right With reference to lots marked with this symbol, the Buyer undertakes to pay the "Artist's Resale Right" that ought to be paid by the seller under Art. 152, 1st Paragraph, Law 633 of 22 April 1941, in accordance with the amount indicated in the "Artist's Resale Right" section above. I Lot sold by a company, where the Hammer price is subject to VAT. TI Lot imported under temporary importation regime pursuant to Art. 72 of the Urbani Code or in connection with which a temporary import has been requested. January 2018 1. DEFINIZIONI (a) Acquirente: la persona fisica o giuridica che fa in asta l'offerta più alta accettata dal banditore, ovvero che acquista il lotto per trattativa privata; (b) Ammontare totale dovuto: è l'importo dovuto per l'aggiudicazione del lotto, oltre alla Commissione d'acquisto e alle Spese; (c) Codice dei Beni Culturali: il Decreto Legislativo del 22 gennaio 2004, n. 42; (d) Commissione d'acquisto: il compenso dovuto ad Art-Rite dall'Acquirente in relazione all'acquisto del lotto e calcolato in misura percentuale al Prezzo di aggiudicazione, in base al valore percentuale indicato nel catalogo d'asta ovvero nelle Condizioni Generali di Vendita, oltre a qualsiasi importo dovuto ad Art-Rite dall'Acquirente a titolo di IVA o di importo in sostituzione di IVA; (e) Contraffazione: secondo l'opinione di Art-Rite, l'imitazione di un lotto offerto in vendita, non descritta come tale nel catalogo d'asta, creata a scopo di inganno su paternità, autenticità, provenienza, attribuzione, origine, fonte, data, età, periodo, che alla data delle vendita aveva un valore inferiore a quello che avrebbe avuto se il lotto fosse stato corrispondente alla descrizione del catalogo d'asta. Non costituisce una contraffazione un lotto che sia stato restaurato o sottoposto ad opera di modifica di qualsiasi natura; (f) Dati: i dati personali, come definiti dall'art. 4, comma 1, lett. b) del D.Lgs. n. 196 del 30 giugno 2003 ("Codice in materia di protezione dei dati personali"), forniti, anche verbalmente e/o telefonicamente, dall'Acquirente, nonché quelli raccolti in dipendenza dell'asta o quelli comunque afferenti la vendita all'asta; (g) Art-Rite: Art-Rite s.r.l., con sede in via Giovanni Ventura 5, Milano, la quale agisce per conto del Venditore in qualità di mandataria con rappresentanza dello stesso; (h) Prezzo: il prezzo a cui il lotto viene aggiudi¬cato in asta dal banditore all'Acquirente o, nel caso di vendita mediante trattativa privata, il prezzo concordato fra Art-Rite e l'Acquirente, al netto della Commissione di acquisto; (i) Riserva: il prezzo minimo (confidenziale) a cui il Venditore ha concordato con Art-Rite di vendere il lotto; (l) Sito: www.art-rite.it; (m) Spese: in relazione all'acquisto di un lotto, sono tutte le spese dovute dall'Acquirente ad Art-Rite e comprendono (ma non si limitano a): le imposte di qualsiasi tipo, i costi di imballaggio e di spedizione, le spese di recupero delle somme dovute dall' Acquirente inadempiente, le eventuali spese di riproduzione del lotto ovvero di sua perizia e/o autentica, il diritto di seguito, che l'Acquirente si impegna a pagare e che spetterebbe al venditore pagare in base all'art. 152, I comma, Legge 22 aprile 1941, n. 633; (n) Venditore è la persona fisica o giuridica proprietaria del lotto offerto in vendita in asta o mediante trattativa privata da Art-Rite, in qualità di sua mandataria con rappresentanza. 2. OBBLIGHI DI ART-RITE NEI CONFRONTI DELL'ACQUIRENTE 2.1 Art-Rite agisce in qualità di mandataria con rappresentanza del Venditore ad eccezione dei casi in cui è proprietaria in tutto o in parte di un lotto. 2.2 I beni sono venduti con ogni difetto, imperfezione ed errore di descrizione. Le illustrazioni dei cataloghi sono effettuate al solo scopo di identificare il lotto. L'Acquirente si impegna ad esaminare il lotto prima dell'acquisto per accertare se lo stesso sia conforme alle descrizioni del catalogo e, se del caso, a richiedere il parere di un esperto indipendente, per accertarne autenticità, provenienza, attribuzione, origine, data, età, periodo, origine culturale ovvero fonte, condizione. 3. RESPONSABILITÀ DI ART-RITE E DEL VENDITORE NEI CONFRONTI DEGLI AC-QUIRENTI 3.1 Ogni rappresentazione scritta o verbale fornita da Art-Rite, incluse quelle contenute nel catalogo, in relazioni, commenti o valutazioni concernenti qualsiasi carattere di un lotto, quale paternità, autenticità, provenienza, attribuzione, origine, data, età, periodo, origine culturale ovvero fonte, la sua qualità, ivi compreso il prezzo o il valore, riflettono esclusivamente opinioni e possono essere riesa¬minate da Art-Rite ed, eventualmente, modificate prima che il lotto sia offerto in vendita. 3.2 Art-Rite e i suoi dipendenti, collaboratori, amministratori o consulenti non sono responsabili degli errori o delle omissioni contenuti in queste rappresentazioni. 3.3 Fatto salvo quanto previsto nelle clausole che precedono, l'eventuale responsabil¬ità di Art-Rite nei confronti dell'Acquirente in relazione all'acquisto di un lotto da parte di quest'ultimo è limitata al Prezzo di aggiudicazione e alla Commis¬sione d'acquisto pagata dall'Acquirente a Art-Rite. Salvo il caso di dolo o colpa grave, Art-Rite ovvero i suoi dipendenti, collaboratori, amministratori o consulenti non saranno responsabili per atti od omissioni relativi alla preparazione o alla conduzione dell'asta o per qualsiasi questione relativa alla vendita dei lotti. 4. VENDITA ALL'ASTA 4.1 L'asta è regolata dalle Condizioni Generali di Vendita e dalle Condizioni Generali di Man¬dato. Le Condizioni Generali di Vendita possono essere modificate mediante un avviso affisso nella sala d'asta o tram¬ite un annuncio fatto dal banditore d'asta prima dell'inizio dell'asta. Nel caso in cui una persona a cui sia stata concessa la pos-sibilità di effettuare un'offerta relativa ad un lotto abbia un interesse diretto o indiretto sul medesimo, quale ad esempio il beneficiario o l'esecutore tes-tamentario che abbia venduto il lotto, oppure il comproprietario del lotto o un'altra parte che abbia prestato una garanzia per il lotto, Art-Rite ne darà comunicazione in catalogo. Le stime pubbli¬cate in catalogo sono solo indicative per i potenziali acquirenti e i lotti possono raggiungere prezzi sia superiori che inferiori alle valutazioni indicate. E' sempre consigliabile interpellare Art-Rite prima dell'asta, poiché le stime pos-sono essere soggette a revisione. Le valutazioni stampate sul catalogo d'asta non comprendono la Commissione d'acquisto e l'IVA. Art-Rite ha il diritto di rifiutare a chiunque di partecipare alle aste. Il banditore conduce l'asta partendo dall'offerta che considera adeguata, in funzione del valore del lotto e delle offerte concorrenti. Il banditore può fare offerte consecutive o in risposta ad altre offerte nell'interesse del Venditore, fino al raggiungimento del Prezzo di riserva. 4.2 Le offerte scritte sono valide soltanto qualora pervengano a Art-Rite almeno 24 ore prima l'inizio dell'asta e siano sufficientemente chiare e complete, in particolare con riferimento al lotto e al prezzo a cui si intende aggiudicare il lotto. Nel caso in cui Art-Rite riceva più offerte scritte di pari importo per uno specifico lotto ed esse siano le più alte risultanti all'asta per quel lotto, quest'ultimo sarà aggiudicato al soggetto la cui offerta sia pervenuta per prima a Art-Rite. Qualora Lei intenda effettuare offerte scritte è pregato di compilare debitamente il "Modulo Offerte" allegato al catalogo d'asta e trasmettercelo unitamente alla documentazione ivi richiesta. 4.3 Le offerte telefoniche sono valide purché siano confermate per iscritto prima dell'asta. Art-Rite si riserva il diritto di registrare le offerte telefoniche e non assume alcuna responsabilità, ad alcun titolo, nei confronti dei partecipanti all'asta per problemi o inconvenienti relativi alla linea telefonica (a titolo di esempio, per interruzione o sospensione della linea telefonica). 4.4 Art-Rite comunicherà sul Sito (almeno 24 ore prima della data dell'asta) e/o sul catalogo l'asta in occasione della quale è possibile formulare offerte anche via internet, nonché i siti di riferimento. Qualora Lei intenda partecipare all'asta via internet avrà la possibilità di fare offerte in tempo reale. La partecipazione all'asta via internet è subordinata alla Sua previa iscrizione al Sito o agli altri siti attraverso i quali è possibile formulare offerte online e alla successiva registrazione all'asta almeno 24 ore prima l'inizio dell'asta. Una volta che Lei ha accesso al Sito in qualità di utente registrato, Lei è responsabile per qualsiasi attività compiuta attraverso il Sito tramite le sue credenziali di accesso. Lei si impegna a comunicare immediatamente ad Art-Rite qualsiasi uso illecito della sua password di accesso al Sito ovvero lo smarrimento della password. In questo caso Art-Rite Le comunicherà una nuova password di accesso al Sito e Lei non potrà più utilizzare la precedente password per accedere al Sito ovvero per partecipare alle aste. Art-Rite non garantisce che il Sito sia sempre operativo e che non vi si siano interruzioni durante la Sua partecipazione all'asta ovvero che il Sito e/o il relativo server siano liberi da virus o da qualsiasi altro materiale dannoso o potenzialmente dannoso. Pertanto, salvo i casi di dolo o colpa grave, Art-Rite non si assume alcuna responsabilità per eventuali problemi tecnici verificatisi in occasione dell'asta (ad esempio, rallentamenti nella navigazione internet o il malfunzionamento del server che gestisce la partecipazione all'asta via internet). Art-Rite non è in alcun modo responsabile per qualsiasi danno ovvero inconveniente da Lei subito per il non corretto uso del Sito ai sensi delle presenti informazioni ovvero delle condizioni di utilizzo del Sito. Lei si impegna a non usare alcun software ovvero strumento di alcun tipo per influenzare ovvero interferire (anche solo potenzialmente) sull'andamento dell'asta e si impegna ad utilizzare il Sito e qualsiasi sua applicazione con correttezza e buona fede. 4.5 Il colpo di martello del banditore determina l'accettazione dell'offerta più alta, il Prezzo di aggiudicazione e, conseguentemente, la conclusione del contratto di vendita tra il Venditore e l'Acquirente. 4.6 Il banditore può, a sua assoluta discrezione e in un momento qualsiasi dell'asta: (i) ritirare un lotto dall'asta; (ii) formulare una nuova offerta di vendita per un lotto, qualora abbia motivi per ritenere che ci sia un er¬rore o una disputa; e/o (iii) adottare qualsiasi provvedimento che ritenga adatto alle circostanze. 4.7 Durante alcune aste potrà essere op-erante uno schermo video. Art-Rite declina ogni responsabilità sia in relazione alla corrispondenza dell'immagine sullo schermo all'originale, sia per errori nel funzionamento dello schermo video. 4.8 Art-Rite dichiara che il lotto può essere oggetto di dichiarazione di interesse culturale da parte del Ministero dei beni e delle attività culturali e del turismo ai sensi dell'art. 13 del Codice dei Beni Culturali. In tal caso o nel caso in cui in relazione al lotto sia stato avviato il pro¬cedimento di dichiarazione di interesse culturale ai sensi dell'art. 14 del Codice dei Beni Culturali Art-Rite ne darà comunicazione prima della vendita. Nel caso in cui il lotto sia stato oggetto di dichiarazione di interesse culturale il Venditore provvederà a denunciare la vendita al Ministero competente ex art. 59 Codice dei Beni Culturali. La vendita sarà sospensivamente condizio¬nata al mancato esercizio da parte del Ministero competente del diritto di prelazione nel termine di sessanta giorni dalla data di ricezione della de-nuncia, ovvero nel termine maggiore di centot¬tanta giorni di cui all'art. 61 comma II del Codice dei Beni Culturali. In pendenza del termine per l'esercizio della prelazione il lotto non potrà essere conseg¬nato all'Acquirente in base a quanto stabilito dall'art. 61 del Codice dei Beni Culturali. 4.9 La Riserva non potrà mai superare la Stima minima pre-vendita annunciata o pubblicata da Art-Rite, salvo nel caso in cui la Riserva sia es¬pressa in una moneta diversa dall'Euro e vi siano sensibili fluttuazioni del tasso di cambio fra la data in cui è stata pattuita la Riserva e la data dell'asta. In tal caso, salvo diverso accordo fra Art-Rite ed il Venditore, la Riserva sarà modificata in un importo pari all'equivalente in Euro in base al tasso ufficiale di cambio del giorno immediatamente precedente quello dell'asta. 5. PAGAMENTO 5.1 L'Acquirente è tenuto a pagare a Art-Rite l'Ammontare totale dovuto immediatamente dopo la conclusione dell'asta. La Commissione d'acquisto è stabilita nella misura del 25,00% del Prezzo di aggiudicazione del lotto fino alla concorrenza dell'importo di euro 3.000,00. Per ogni parte del Prezzo di aggiudicazione eccedente l'importo di euro 3.000,00 la commissione d'acquisto è stabilita nella misura del 23,00% fino alla concorrenza dell'importo di euro 500.000,00. Per ogni parte del Prezzo di aggiudicazione eccedente euro 500.000,00 la commissione d'acquisto è stabilita nella misura del 18,00%. Le percentuali sopra indi¬cate sono inclusive di IVA ovvero di qualsiasi somma sostitutiva di IVA. Qualora nel catalogo d'asta, in relazione ad uno specifico lotto, siano indicate percentuali diverse rispetto a quelle qui indicate con riferimento alla Commissione d'acquisto, le percentuali indicate in catalogo saranno da ritenersi prevalenti. Un'Imposta sul Valore Aggiunto (IVA) può essere applicata sul Prezzo di aggiudicazione e/o sulla Commissione di acquisto. Al fine di armonizzare le procedure fiscali tra i Paesi dell'Unione Europea, con decorrenza dal 1° gennaio 2001 sono state introdotte in Italia nuove regole con l'estensione alle Case d'Asta del regime del margine. L'art. 45 della legge 342 del 21 No¬vembre 2000 prevede l'applicazione di tale regime alle vendite concluse in esecuzione ai contratti di commissione definiti con: (a) soggetti privati; (b) soggetti passivi d'imposta che hanno assogget¬tato l'operazione al regime del margine; (c) soggetti che non hanno potuto detrarre l'imposta ai sensi degli art. 19, 19-bis, e 19-bis2 del DPR. 633/72 (che hanno venduto il bene in esenzione ex-art. 10, 27-quinquies); (d) soggetti che beneficiano del regime di franchigia previsto per le piccole imprese nello Stato di appartenenza. In forza della speciale normativa, nei casi sopraci¬tati eventuale imposta IVA, ovvero una somma sostitutiva di IVA, se applicabile, viene applicata da Art-Rite. 5.2 Il trasferimento della proprietà del lotto dal Venditore all'Acquirente avverrà solt¬anto al momento del pagamento da parte dell'Acquirente dell'Ammontare totale dovuto. Se Lei si è aggiudicato un lotto, il pagamento deve essere effettuato im-mediatamente dopo l'asta e può essere corrisposto nei seguenti metodi: contanti, assegno circolare, assegno bancario, Bancomat o Carta di Credito (American Express, Visa o Mastercard), Paypal. Art-Rite può accettare pagamenti singoli o multipli in contanti solo per importi inferiori a euro 2.999,99. Le coordinate bancarie per i bonifici sono le seguenti: IBAN: IT53-K-05034-11301-000000011412; SWIFT: BAPPIT21680. 5.3 In caso di mancato o ritardato pagamento da parte dell'Acquirente, in tutto o in parte, dell'Ammontare totale dovuto, Art-Rite ha diritto, a propria scelta, di chiedere l'adempimento ovvero di risolvere il contratto di vendita a norma dell'art. 1454 c.c. intendendosi il termine per l'adempimento ivi previsto convenzionalmente pattuito in cinque (5) giorni, salvo in ogni caso il diritto al risarcimento dei danni, nonché la facoltà di far ven¬dere il lotto per conto ed a spese dell'Acquirente, a norma dell'art. 1515 c.c. 5.4 In caso di mancato o ritardato pagamento da parte dell'Acquirente, in tutto o in parte, dell'Ammontare totale dovuto, Art-Rite ha diritto di imputare qualsiasi pagamento fatto dall'Acquirente ad Art-Rite al debito dell'Acquirente rappresentato dall'Ammontare totale dovuto ovvero a qualsiasi altro debito dell'Acquirente nei confronti di Art-Rite derivante da altri rapporti con¬trattuali. 5.5 In caso di ritardo nel pagamento dell'Ammontare totale dovuto per un periodo superiore a cinque (5) giorni lavorativi dalla data dell'asta Art-Rite depositerà il lotto presso di sé o altrove a rischio e onere dell'Acquirente. Sempre in caso di ritardo nel pagamento per un periodo superiore a quello sopra indicato, l'Acquirente dovrà pagare a Art-Rite interessi moratori in misura pari al tasso Euribor a 3 mesi maggiorato di uno spread del 2%, salvo il diritto di Art-Rite al risarcimento del maggior danno. Il lotto sarà consegnato all'Acquirente solo dopo che quest'ultimo abbia pagato a Art-Rite l'Ammontare totale dovuto, tutte le spese di deposito, trasporto e qualsiasi altra spesa sostenuta. 5.6 In caso di mancato o ritardato pagamento da parte dell'Acquirente Art-Rite potrà rifiutare qualsiasi offerta fatta dall'Acquirente o da un suo rappresentante nel corso di aste successive o chiedere all'Acquirente di depositare una somma di denaro, a titolo di garanzia, prima di accettare offerte. 5.7 Art-Rite ha la facoltà di compensare ogni somma dovuta, a qual¬siasi titolo, all' Acquirente con ogni somma do¬vuta da quest'ultimo, a qualsiasi titolo a Art-Rite. 6. CONSEGNA E RITIRO DEL LOTTO 6.1 La consegna del lotto all'Acquirente avverrà a spese di quest'ultimo, non oltre cinque (5) giorni lavorativi dal giorno della vendita. Il lotto sarà consegnato all'Acquirente (ovvero a soggetto debitamente autorizzato da quest'ultimo) soltanto dopo che Art-Rite avrà ricevuto l'Ammontare totale dovuto. 7. TRASFERIMENTO DEL RISCHIO 7.1 Un lotto acquistato è interamente a rischio dell'Acquirente a partire dalla data più anteced¬ente fra quelle in cui l'Acquirente: (i) prende in consegna il lotto acquistato; o (ii) paga l'Ammontare totale dovuto per il lotto; ovvero (iii) dalla data in cui decorre il termine di cinque (5) giorni lavorativi dal giorno della vendita. 7.2 L'Acquirente sarà risarcito per qualsiasi perdita o danno del lotto che si verifichi dopo la vendita ma prima del trasferimento del rischio, ma il risarcimento non potrà superare il Prezzo di aggiudicazione del lotto, oltre alla Commissione d'acquisto ricevuta da Art-Rite. Salvo il caso di dolo o colpa grave, in nessun caso Art-Rite si assume la responsabilità per la perdita o danni di cornici/vetro che contengono o coprono stampe, dipinti o altre opere a meno che la cornice o/e il vetro non costituiscano il lotto venduto all'asta. In nessun caso Art-Rite sarà responsabile per la perdita o il danneggiamento verificatisi a seguito di un qualsiasi intervento da parte di esperti indipendenti incari¬cati da Art-Rite con il consenso del Venditore per la perdita o il danneggiamento causati o derivanti, direttamente o indirettamente, da: (i) cambiamenti di umidità o temperatura; (ii) normale usura o graduale deterioramento derivanti da interventi sul bene e/o da vizi o difetti occulti (inclusi i tarli del legno); (iii) errori di trattamento; (iv) guerra, fissione nucleare, contaminazione radioattiva, armi chimiche, biochimiche o elettro-magnetiche; (v) atti di terrorismo. 7.3 L'imballaggio e la spedizione del lotto all' Acquirente sono interamente a suo rischio e carico e in nessuna circostanza Art-Rite si as¬sume la responsabilità per azioni od omissioni degli addetti all'imballaggio o dei trasportatori. 8. ESPORTAZIONE DAL TERRITORIO DELLA REPUBBLICA ITALIANA 8.1 L'esportazione di beni culturali al di fuori del ter¬ritorio della Repubblica italiana è assoggettata alla disciplina prevista dal D. Lgs. 22 gennaio 2004, n. 42. L'esportazione di beni culturali al di fuori del territorio dell'Unione Europea è altresì assogget¬tata alla disciplina prevista dal Regolamento CE n. 116/2009 del 18 dicembre 2008 e dal Regolamento UE di esecuzione della Commissione n. 1081/2012. L'esportazione dal territorio della Repubblica italiana di un lotto può essere soggetta al rilascio di una autorizzazione. Il rilascio di questa autorizzazione è a carico e cura dell'Acquirente. Il mancato rilascio dell'autorizzazione (ad es.: attestato di libera circolazione e/o licenza di esportazione) non costituisce una causa di risoluzione o di annullamento della ven¬dita, né giustifica il ritardato pagamento da parte dell'Acquirente dell'Ammontare totale dovuto. 9. LEGGE APPLICABILE E GIURISDIZIONE 9.1 Le presenti Condizioni Generali di Vendita sono regolate dalla legge italiana. L'Acquirente accetta che ogni e qualsiasi controversia che dovesse sorgere in relazione all'applicazione, interpretazione ed esecuzione delle presenti Condizioni Generali di Vendita sia devoluta alla compe¬tenza esclusiva del Foro di Milano. 10. TUTELA DATI PERSONALI 10.1 Ai sensi dell'art. 13 del D. Lgs. n. 196 del 30 giugno 2003 ("Codice in materia di protezione dei dati personali"), Art-Rite informa che i Dati da Lei conferiti ad Art-Rite saranno trattati da quest'ultima principalmente con l'ausilio di mezzi elettronici, automatizzati e/o di videoregistrazione (secondo le modalità e con gli strumenti idonei a garantire la sicurezza e la riservatezza dei Dati stessi) per: (a) esigenze funzionali all'esecuzione delle proprie obbligazioni, (b) esigenze gestionali del rapporto con i venditori ed i compratori, (quali, ad es., amministrazione di proventi di vendita, fatture, spedizioni), (c) verifiche e valutazioni sul rapporto di vendita all'asta nonché sui rischi ad esso connessi, (d) per adempimenti di obblighi fiscali, contabili, legali e/o di disposizioni di organi pubblici ovvero, (e) l'invio di materiale pubblicitario ed informativo da parte di Art-Rite a mezzo di sistemi automatizzati, quali e-mail, fax, sms o MMS. 10.2 Il conferimento dei Dati per le finalità di cui all'art. 10.1 lettere (a) - (d) comprese è facoltativo. Tuttavia, un eventuale rifiuto comporterà l'impossibilità di partecipare all'asta ovvero il corretto adempimento delle obbligazioni gravanti su Art-Rite. 10.3 L'assenso al trattamento dei Dati per la finalità di cui all'art. 10.1 lett. (e) è facoltativo. Tuttavia il mancato assenso comporterà l'impossibilità di ricevere materiale pubblicitario ed informativo da parte di Art-Rite a mezzo di sistemi automatizzati, quali e-mail, fax, sms o MMS. 10.4 I Dati verranno trattati dai dipendenti o collaboratori di Art-Rite in qualità di incaricati o di responsabili del trattamento. 10.5 I Suoi Dati potranno essere inoltre comunicati a: (a) tutti quei soggetti (ivi incluse le Pubbliche Autorità) che hanno accesso ai dati personali in forza di provvedimenti normativi o amministrativi; (b) alle società o soggetti terzi incaricati dei servizi di stampa, imbustamento, spedizione e/o consegna dei lotti acquistati; (c) a uffici postali, corrieri o spedizionieri incaricati della consegna dei lotti acquistati; (d) a società, consulenti o professionisti eventualmente incaricati dell'installazione, della manutenzione, dell'aggiornamento e, in generale, della gestione degli hardware e software di Art-Rite, o di cui Art-Rite si serve, compreso il Sito; (e) a società o Internet provider incaricati dell'invio di documentazione e/o materiale informativo ovvero pubblicitario; (f) a società incaricate dell'elaborazione e/o dell'invio di materiale pubblicitario ed informativo per conto di Art-Rite; (g) a tutti quei soggetti pubblici e/o privati, persone fisiche e/o giuridiche (studi di consulenza legale, amministrativa e fiscale, Uffici Giudiziari, Camere di Commercio, Camere ed Uffici del Lavoro, ecc.), qualora la comunicazione risulti necessaria o funzionale al corretto adempimento degli obblighi gravanti su Art-Rite. I Suoi Dati non saranno diffusi, se non in forma anonima ed aggregata, per finalità statistiche o di ricerca. 10.6 Titolare del trattamento dei Dati è Art-Rite s.r.l, con sede legale a 20134 Milano, via Giovanni Ventura 5, al quale è possibile rivolgere istanze e richieste relative al trattamento dei Dati. 10.7 I Dati saranno conservati per il solo tempo necessario a garantire la corretta prestazione delle obbligazioni facenti capo ad Art-Rite, e comunque entro i limiti consentiti dalla legge. 10.8 Ai sensi dell'art. 7 del Codice della Privacy, Lei ha diritto, tra l'altro di: (a) ottenere la conferma dell'esistenza o meno di dati personali che lo riguardano e la loro comunicazione in forma intellegibile; (b) ottenere, a cura del titolare o del responsabile/dei responsabili del trattamento: - indicazioni sull'origine dei Dati, sulle finalità e sulle modalità del trattamento, sulla logica applicata in caso di trattamento effettuato con l'ausilio di strumenti elettronici; - indicazione degli estremi identificativi del titolare del trattamento e del responsabile/dei responsabili, nonché eventualmente del rappresentante designato da un soggetto straniero al trattamento dei dati in Italia; - indicazioni circa i soggetti o le categorie di soggetti a cui i dati possono essere comunicati o che possono venire a conoscenza degli stessi in qualità di rappresentante designato sul territorio dello stato, di responsabili o incaricati; (c) ottenere: - l'aggiornamento, la rettificazione o l'integrazione dei dati che La riguardano; -la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati; - l'attestazione del fatto che le operazioni di cui ai punti che precedono sono state portate a conoscenza anche per quanto riguarda il loro contenuto, di coloro ai quali i Dati sono stati comunicati o diffusi, salvo il caso in cui tale adempimento risulti impossibile o comporti l'impiego di mezzi manifestamente sproporzionati rispetto al diritto tutelato; (d) opporsi, in tutto o in parte: - per motivi legittimi, al trattamento dei Dati che La riguardano, ancorché pertinenti allo scopo della raccolta; - al trattamento dei Dati che La riguardano, previsto ai fini di informazione commerciale o di invio di materiale pubblicitario o di vendita diretta ovvero per il compimento di ricerche di mercato o di comunicazione commerciale. DIRITTO DI SEGUITO 11.1 Il 9 aprile 2006 è entrato in vigore il Decreto Legislativo 13 febbraio 2006, n. 118, che, in attuazione della Direttiva 2001/84/CE, ha introdotto nell'ordinamento giuridico italiano il diritto degli autori di opere d'arte e di manoscritti, ed ai loro aventi causa, a percepire un compenso sul prezzo di ogni vendita dell'originale successiva alla prima (c.d. "diritto di seguito"). Il "diritto di seguito" è do¬vuto solo se il prezzo della vendita non è inferiore a euro 3.000,00. Esso è così determinato: (i) 4% per la parte del prezzo di vendita compresa tra euro 0 e euro 50.000,00; (ii) 3% per la parte del prezzo di vendita compresa tra euro 50.000,01 e euro 200.000,00; (iii) 1% per la parte del prezzo di vendita compresa tra euro 200.000,01 e euro 350.000,00; (iv) 0,5% per la parte del prezzo di vendita com¬presa tra euro 350.000,01 e euro 500.000,00; (v) 0,25% per la parte del prezzo di vendita superi¬ore a euro 500.000,00. Art-Rite, in quanto casa d'aste, è tenuta a versare il "diritto di seguito" alla Società italiana degli autori ed editori (S.I.A.E.). Per ciascuna opera, l'importo del diritto di seguito non può essere superiore a euro 12.500,00. Oltre al Prezzo di aggiudica¬zione, alle Commissioni di acquisto e alle altre Spese, l'Acquirente si impegna a pagare il "diritto di seguito", che spetterebbe al venditore pagare in base all'art. 152, I comma, Legge 22 aprile 1941, n. 633. 12. SIMBOLI II seguente elenco spiega i simboli che si possono trovare nel catalogo di Art-Rite. "o" Importo minimo garantito Nel caso in cui un lotto sia contrassegnato da questo simbolo al Venditore è stato garantito un importo minimo nell'ambito di una o più aste. "P" Lotti di proprietà di Art-Rite Nel caso in cui i lotti siano contrassegnati da questo simbolo la proprietà appartiene in tutto o in parte a Art-Rite. "SR" Senza Riserva Qualora i lotti illustrati nel catalogo non siano contrassegnati da questo, si intendono soggetti alla vendita con riserva. Qualora tutti i lotti contenuti nel catalogo siano soggetti alla vendita senza riserva non verrà utilizzato alcun simbolo in relazione ai singoli lotti. ® Diritto di Seguito Per i lotti contrassegnati da questo simbolo l'Acquirente si impegna a pagare il "diritto di seguito", che spetterebbe al venditore pagare in base all'art. 152, I comma, Legge 22 aprile 1941, n. 633, nella misura determinata nella sezione "Diritto di Seguito" di cui sopra. "I " Lotto proveniente da impresa, dove il valore di aggiudicazione è soggetto ad IVA. "TI " Lotto in regime di temporanea importazione ex art. 72 del Codice Urbani o per il quale è stata richiesta la temporanea importazione. Gennaio 2018 SHIPPING TERMS Upon collection of the lot, the Buyer will be required to exhibit a document (passport or driving license) proving his identity. Lots will be delivered to the Buyer or any other person in charge of collection designated by the same only after payment. Art-Rite is at your disposal for information concerning the exportation and shipment of lots. Art-Rite on request can provide a list of selected International shippers. The cost of shipment will be borne by the Buyer. The insurance coverage concerning any risk of loss and/or damage (also partial) that the lot may suffer during transport must be agreed by the Buyer and the carrier without any liability for Art-Rite.
