Private Selection - Exceptional Luxury Items

The following, as amended by any posted notices or announcements during the sale, constitutes the entire terms and conditions on which item listed in the catalog shall be offered for sale or sold by BIDHAUS LLC (BIDHAUS). PLEASE READ THIS ENTIRE AGREEMENT. Terms and Conditions of Sale Please be advised that by placing a bid, you are entering into a legally binding contract with BIDHAUS. If you are the successful and winning bidder, you shall have a legal obligation to purchase the item(s) bid from BIDHAUS. Place a bid only if you are serious about buying the item. Any questions before bidding should be resolved by contacting BIDHAUS. BIDHAUS reserves the right to withdraw or combine any lots listed in the auction at any time with no liability. Furthermore, BIDHAUS reserves the right to cancel or replace an order post auction if (a) it does not successfully pass and meet quality control standards prior to shipping, (b) is no longer available because products are offered simultaneously on multiple platforms, or (c) it was sold in error by the auctioneer/clerk. In the event this occurs, BIDHAUS may provide the winning bidder with the same or similar item at no additional charge to the bidder or at BIDHAUS discretion, provide a refund or credit. The successful bidder is the highest bidder acknowledged by the Auctioneer. BIDHAUS and its Auctioneers will have final discretion in determining the successful bidder and in resolving any disputes between bidders. If any dispute arises after the sale, the BIDHAUS sale record shall be conclusive. Successful bidders must pay for the entire invoice before said items are removed from inventory or other online platforms. Many items are consigned to Bidhaus and may be sold simultaneously on multiple online platforms. If a listed item shall become unavailable, Bidhaus will attempt to remove the item from the auction on best efforts basis. Subsequently, BIDHAUS may provide the winning bidder with the same or similar item at no additional charge to the bidder or at BIDHAUS discretion, provide a refund or credit. Buyers Premium Each lot sold at the auction is subject to a twenty-five percent (25%) buyers premium. In addition, bidders may be charged sales tax per state and federal tax laws. Payment Payments for winning bids may be made with Visa, MasterCard, Discover, AMEX, Bitcoin and bank wire transfers. If you choose to pay by credit card, please note that we may impose an additional surcharge on the transaction amount, which is not greater than our cost of acceptance. All items must be paid for within forty-eight (48) hours from the date of auction. All Gold and Platinum purchases must be made within twenty-four (24) hours from the date of auction. BIDHAUS reserves the right to replace items with similar items should payment be received after this 48 hour payment window. If no replacement is available, a credit will be issued for use on any other BIDHAUS purchase. BIDHAUS reserves the right to delay shipment of items until all funds have fully cleared. Any payments due to BIDHAUS exceeding $2,000.00 or any new bidders lacking sufficient successful auction payment history, may be required to wire funds at the sole discretion of BIDAHUS. Please note, if you have not contacted us to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the full amount listed on your invoice. Shipping, Handling and Insurance BIDHAUS provides handling, packing and shipping services at the expense of the Buyer. Bidhaus will make every attempt to ship items within 5-10 business days barring any unforeseen shipping delays as a result of Covid-19. An ESTIMATED SHIPPING and HANDLING AMOUNT will be included in the auction invoice after the sale. All U.S. domestic shipments will be insured at the total bid amount contained in the shipment at the sole discretion of BIDHAUS (other add-on charges are not covered by insurance). We pay for insurance services at our own expense as a security for both our Bidders and BIDHAUS. An Adult Signature is required upon delivery of all Bidhaus items. Large, heavy, fragile or otherwise unusual items will incur additional charges. We mainly use USPS, UPS or FedEx Ground Shipping on domestic shipments, which may take three (3) to seven (7) business days. Under special circumstances, BIDHAUS may ship items using UPS or FedEx Express Mail, private carriers or pack and ship enterprises, the cost of which shall be charged to the Bidder. BIDHAUS will not use lower classes of mail to ship sold merchandise due to increased risk of loss. Special shipping and handling requests may be accommodated on a limited basis at BIDHAUS sole discretion and may incur additional handling charges. All costs charged to a Bidders original invoice are estimates and BIDHAUS reserves the right to charge additional amounts if such estimates are exceeded. By acknowledging this Agreement, Buyer agrees to any additional charges as may be necessary to accommodate special shipping and handling requests. Shipping and handling charges to Hawaii, Alaska, the U.S. Territories and Foreign Countries are higher and often require registry or express mail. The shipping carriers may also limit insurance coverage to foreign locations. BIDHAUS will allow pickups on a case by case basis at its sole discretion. International Shipping BIDHAUS will ship items to foreign locations using the same classes of mail and additional postal services that it uses to ship to U.S. locations, to the extent that such services are available. Please be advised that insurance coverage may be limited or unavailable for those locations. To the extent foreign bidders are aware of alternative shipping arrangements, which may be desired to increase insurance coverage, we advise them to notify BIDHAUS of such options. BIDHAUS shall not be liable for any shortfall of insurance either on foreign shipments or on the non-coverage of additional invoice charges exceeding bid amounts. BUYERS ARE RESPONSIBLE FOR ALL INTERNATIONAL CUSTOMS DUTIES AND/OR TAXES. We are not told in advance of what a given country may charge for customs duties and/or taxes. Condition We have tried to accurately describe every item. Condition and substantial defects are noted or photographed, minor defects or smells may not be mentioned (these are to be expected in pre-owned or vintage items). Please review images carefully as all items are sold AS IS. Keep in mind that on certain monitors, photos and light may depict slight color variations. Unless specified in the lot description, item may not come with box, papers, dust-bags, or authenticity card/certificates. Authenticity - Bags and Accessories BIDHAUS guarantees all items to be 100% authentic. As an additional option, for most handbags, BIDHAUS can provide a 3rd party authentication certificate through Entrupy, one of the most trusted authentication services in the industry. Bidhaus reserves the right to charge up to $50 for this service. This Certification of Authenticity does not imply that the item will be certified by any other rival authentication companies. The accompanied Entrupy certification is the only certification the auction company can provide unless specified otherwise. Authenticity - Jewelry BIDHAUS guarantees all items to be 100% authentic. Bidhaus makes no warranties, express or implied, of any kind related either to to the value, marketability or condition of the lot described in any listing. All bidders should conduct due diligence prior to placing any bids. By placing a bid, Bidder acknowledges that proper due diligence has been conducted and agrees to accept the winning item with no objections. All questions should be submitted prior to placing any bids. When a pre-auction report is provided through a 3rd party jewelry grading and valuation company, retail replacement value is provided but does not constitute an estimate for resale, wholesale, or insurance replacement value. Bidhaus does however assure that all items will be as described in lot descriptions and pre-auction reports when available. Bullion & Coins Payment - All Gold and Platinum purchases must be made within twenty-four (24) hours from the date of auction. All precious metal items are subject to availability and sale may be cancelled if unavailable. If specified coin year is unavailable, a replacement of equal value with random year will be provided. If specified hallmark or design is unavailable, a replacement of equal value will be provided. Shipping- Packages will be sent by registered and insured mail, and can take on average 5-10 Business Days or more to receive. A signature is required for acceptance. Domestic Taxation- Depending upon your states taxation laws with regard to the purchase of precious metals, you may be subject to pay state sales tax. Your Invoice will be adjusted accordingly. International Duties- All duties and taxes must be paid by the winning bidder upon their items delivery and are the full responsibility of the winning bidder. Please consult your local customs for more information on duty and tax rates in your respective Country with regard to both the purchase and importation of precious metals. BIDHAUS always declares the full value of the shipment on any customs form. There are no exceptions to this rule. Risk Disclosure- All investments involve risk; Bullion and Coins are no exception. The value of a gold or platinum (ie. Bullion bars., American Eagles or Canadian Maple Leafs) is affected by many economic factors, including the current market price of Bullion, the scarcity of the physical supply of precious metals and other factors. Some of these factors include the quality and current demand and general market sentiment. Therefore, because both Bullion and Coins can go down in price as well as up, investing in them may not be suitable for everyone. Because all investments, including Bullion and Coins, can decline in value, you should understand them well, and have adequate cash reserves and disposable income before considering an investment in Bullion or Coins. However, all investments, of every type, involve some level of risk and Precious Metals are no exception. Like many markets, the Precious Metals market is speculative, and it is unregulated. The value of any Bullion item is generally determined by current spot price of the underlying Precious Metal, and by the supply and demand for these particular items. These prices will fluctuate throughout the day while the Precious Metals market is open. If you are considering purchasing Precious Metals as an investment, you should assess the stability of the current market and contact your financial advisor for all advice. Please be guided accordingly. Guarantee- BIDHAUS does guarantee that every item that we sell is genuine and that all Precious Metal items do contain the weight, fineness, and purity that we have advertised. Supporting documentation will be provided with your package confirming such information. Returns- Under no circumstances shall an item be eligible for return. All sales are final and all winning bids constitute a binding contract to purchase an item. Please carefully review all of our Terms and Conditions, especially these specific Terms and Conditions as defined herein. Returns All items are sold AS IS, WHERE IS, with all faults, and ALL SALES ARE FINAL. Returns may only be made with written authorization of BIDHAUS, at BIDHAUS sole discretion. To request a return, you must provide a written request fully explaining the basis for the return no later than three (3) days after your receipt of the lot. Under no circumstances will any amounts other than the winning bid amount be refunded. A restocking fee of 25% of the full invoice amount may apply. All authorized returns must be received in the same condition as when originally shipped to Buyer, or they will be returned to Buyer at Buyers cost. Any unauthorized returns will be discarded and bidder will relinquish all claims to said items. Refusal to accept merchandise delivered by BIDHAUS to the bidder constitutes an unauthorized return in direct violation of these general terms and conditions. Liability and Disclaimer BIDHAUS and its Vendors disclaim any warranties, express or implied, including but not limited to the Implied Warranty of Merchantability or Fitness for any particular purpose. Neither BIDHAUS, nor its Vendors will be held responsible for any descriptions of the rarity, quality, condition, size, importance, or provenance of the item. While BIDHAUS representatives, to the best of their ability, describe the items for sale, any statement, whether oral or written, by the Auctioneer or by any BIDHAUS representative are mere opinions and shall not be deemed a warranty or representation regarding the item offered for sale. Any low or high estimate provided in the auction catalogue or by the Auctioneer prior to, or during the live auction does not constitute an appraisal and does not represent a resale value. Estimates are provided merely as an estimation of similar items in new, retail conditions and are meant to juxtapose the sale of new items versus purchasing second hand. The bidder is responsible for determining the age, size, condition and value of the item before bidding.
