BIDDER RESPONSIBILITIES
Bidder is responsible for any and all activity, bids, and purchases involving Bidder's account. Once a bid has been placed, it cannot be lowered or deleted. Bidder agrees to keep its username and password confidential.
CONDITIONS
Brandywine Valley Auctions has endeavored to accurately describe the items being sold, but all property offered for sale is strictly "as - is" "where - is" with all faults. All sales are final and no refunds are given. The sales records and recordings shall be conclusive. It is the bidder's responsibility to determine the exact condition/authenticity of each item. No statement in this catalogue or by representatives of Brandywine Valley Auctions shall be considered as a warranty or assumption of liability. Written and oral descriptions given by Brandywine Valley Auctions staff members are given as a courtesy to a client, are only an opinion, and should not be considered as a guarantee of age, composition, or authenticity. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear or imperfections. High resolution images are provided to assist a bidder in making an additional assessment of condition. By bidding, you signify that you are satisfied with the written and verbal descriptions as well as the accompanying photographs. The auctioneer always reserves the right to withdraw a lot for any reason he deems appropriate, if there is a lack of bidding interest or lack of appropriate bids.Brandywine Valley Auctions shall have the right to withdraw any item at any time for any reason and to default any sale in the event of an error or dispute. Bid approval and acceptance on Live Auctioneers is at the discretion of the auctioneer.
REGISTRATION
Absentee bidders and telephone bidders may create an account by calling 215-872-5240. Bidders on the live Auctioneers platform can register and bid through their platform by filling out their registration form. Absentee Bidders and Telephone bidders: All domestic US bids must be secured with a MasterCard or Visa.
BIDDING
When Absentee bidding, you may accept the current asking bid or enter a maximum bid value. Live real-time internet bidding does not allow a maximum bid to be entered, only the current asking bid may be accepted. Absentee bidding is available before a lot has come up. Once a lot has come up, live auctioneers bidding is available on the website and absentee bids can no longer be placed. Brandywine Valley Auctions cannot be held liable for Live Auctioneers Bids that are not sent, received, or executed.
Phone bidding can be arranged at Brandywine Valley Auctions, 215-872-5240, up to one (1) hour before the start of the auction. No additional phone bids can be accepted after this time, including additions when speaking with a staff person. Once a phone bid has been placed, contact numbers cannot be changed. International bidders are responsible for entering appropriate country code and phone number. Placing a telephone bid indicates the bidder is willing to open the bidding at one half the low estimate.
All bids will be executed in a fair, competitive and confidential manner. While every effort is made to execute and honor bids, Brandywine Valley Auctions is not responsible for failure to execute a bid and is not liable for any losses incurred as a result of failure to execute a bid. If you are bidding live auctioneers.com, please bid quickly as there may be a time delay in receiving the live bid. In case of identical bids, the first bid received will take precedence. Where appropriate, bids will be rounded down to the nearest amount consistent with the auctioneer's bidding increments. NOTE: It is the bidder's responsibility to accurately record Lot Number, Bid Amount or Telephone Number on any bids submitted. Brandywine Valley Auctions assumes no responsibility or liability in the event a bidder fails to do so. Bids cannot be submitted, altered, or cancelled via voicemail. Five lots prior to any lot approaching the podium, outbid notifications will not be received.
BID LIMITS
New participants bidding through www.liveauctioneers.com with less than one year of purchase history will be accepted at the discretion of Brandywine Valley Auctions. A deposit may be required at the discretion of Brandywine Valley Auctions.
OWNERSHIP
Item ownership is conveyed immediately following the fall of the Auctioneer's hammer. While we try to handle and store items with great care,Brandywine Valley Auctions will have no liability for any loss or damage to an item after the hammer has fallen.Brandywine Valley Auctions is not liable for any damages incurred if assistance with loading is requested. Once an item(s) has been paid for, we will place item(s) together for DAKS Global Logistics, LLC. to come over and pick-up items for packing and shipping at their building.
LOADING
Loading will be handled by DAKS Global Logistics, LLC. once the items have been paid for. Until that time, the items will be stored accordingly based on how many lots were won by a specific bidder.
STORAGE
Unless prior arrangements are made, payment within 5 business days, or a $5 per lot per day storage fee will be charged.
ABANDONED PROPERTY
Unless prior arrangements have been made, any lot(s) remaining at the Brandywine Valley Auctions more than 90 calendar days after the auction purchase date will be considered abandoned and no refunds will be given. Brandywine Valley Auctions is not obligated to notify the winning bidder of the abandoned lot(s).
DISPUTES
Any and all disputes resulting or arising in connection with this auction shall be heard in the County Court of Common Pleas of Chester County, Pennsylvania as the sole and exclusive venue.
LEGAL INTERPRETATIONS
This document will be interpreted by the laws of the State of Pennsylvania and by the United States Code.
