Shipping, Payment & Auction Policies Shipping We will provide in-house shipping via USPS, unless you request another shipping provider. Shipping arrangements are not necessary unless you wish to have your order shipped by a different party other than Western Auctions. If you wish to have your items shipped by another provider, please contact us and the party you wish to provide shipping for your item(s) prior to payment of your invoice(s). We will then take your items to the other party for shipment. If you do not want insurance, please contact us via email PRIOR TO PAYING INVOICE, and we will remove it. Shipping costs are estimated, and Western Auctions reserves the right to adjust shipping charges for items after invoices are sent. You will be notified in this case. Shipping is calculated based on delivery address, packaging material, weight, and handling. Payment Payment is due within 5 days of receiving your invoice. Please also see the terms and conditions for Live Auctioneer fee and Credit Card Fees, as well as Buyer's Premium. Auto-pay If you have not contacted Western Auctions to arrange payment within 3 days that your invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice. Payment Type Western Auctions will accept all major Credit Cards as payment. You may request to complete a Wire Transfer so long as you contact us within 3 days of receiving your invoice. We will then get you the information needed to complete the transfer, and change the fees as needed in your invoice. RETURNS There is a 30 day return available for items with Authenticity concerns. In the listings I will state if the item(s) are Reproductions, Altered, or are believed to be Authentic. In the case of Authentic items, you must send your item(s) to 2 Reputable Authenticaters. Should they both "kill" the item(s), you may email us though www.liveauctioneeers.com or arrowheadcollector789@yahoo.com. We will then direct you as to how to best return the item(s) in question for full refund. (YOU MUST INCLUDE THE "KILL" LETTER(S) WITH YOUR RETURN. THE ITEM(S) MUST ALSO BE IN THEIR ORIGINAL / UNALTERED STATE, AND WITH ALL ORIGINAL INCLUDED DOCUMENTS TO RECEIVE FULL REFUND WITHIN 30 DAYS.) Only items listed as AUTHENTIC are GUARANTEED to be so, and as such are subject to return. ALL other listings, (Reproduction, Altered, Re-chipped, Unknown) are not subject to return, and are sold as is. TERMS OF SALE ALL ARTIFACTS, ARROWHEADS, TOOLS AND SUCH IN WESTERN AUCTIONS ARE LEGALLY OBTAINED. NO LAWS WERE BROKEN OBTAINING THESE ITEMS. THEY WERE ALL FOUND LEGALLY ON PRIVATE PROPERTY OR FOUND PRIOR TO 1970. All items being offered in this collection are being offered as is, where is and with all faults, known and unknown. Western Auctions makes no warranties or guarantees whatsoever as to the quality, quantity, or condition of any article or lot. Descriptions have been prepared for guide purposes only and shall not be relied upon by Buyer for accuracy or completeness. By submitting a bid, Buyer/Bidder affirms they have inspected all items or has waived their right to do so prior to bidding. Buyers shall be deemed to have relied entirely upon their own inspections and investigations. ALL ITEMS MUST BE PAID WITHIN 5 BUSINESS DAYS OF END OF AUCTION 1. Buyer is required to make payment in full within 5 business days of end of auction. Payments are accepted in the form of credit card and wire transfer. You can call to place a credit card payment by phone; however, we discourage it as we cannot provide a secure network to protect your information. All bidding and invoicing will be in US Dollars ($); the above approved forms of payment must be made in US currency. a) Non-payment in said time will result in suspension of bidding with Western Auctions, as well as being reported to Live Auctioneers for non-payment. This can result in Bidder being suspended with other Auctions through Live Auctioneers in the future. b) If you have any issues with making payment on time, or within the 5 days, contact Western Auctions by email through www.liveauctioneers.com, or arrowheadcollector789@yahoo.com to see about other accommodations or assistance. Communication before the auction date or bidding time is appreciated. 2. A premium of 15% of the bid price will be added to the price of each item purchased. 3. All articles will be sold to the highest bidder conforming to the bid process. The Auctioneer shall be entitled to make changes in (the composition of) the lots or to withdraw them, up until the last moment before the sale. All sales shall be concluded on the fall of the hammer or as indicated by Auctioneer and no Buyer may thereafter revoke his bid. 4. Any announcements made on the day of the auction take precedence over catalogue or other previously announced or documented information, but do not alter in any way the basic terms and conditions of sale. We reserve the right to correct any mistakes or typographical errors made on its behalf in any of its announcements or documents. 5. All property must be paid for in the time frames announced by Auctioneer at time of sale. If not, the merchandise will be deemed abandoned and Buyer will lose any right, title or interest Buyer may have acquired and the merchandise shall revert and repossess to Auctioneer without further notice to Buyer and Buyer's deposit, if any, will be forfeited. No purchaser may assign, transfer, or dispose of his rights in any article purchased before he has paid the purchase price in full. 6. We provide in-house shipping via USPS. If the buyer wishes to waive insurance coverage, they must notify Western Auctions by email prior to paying the invoice, so a new invoice can be sent. Some items deemed extremely fragile or large will also be insured, regardless of invoice totals. 7. If any applicable conditions are not complied with by Buyer, then, in addition to any other remedies available to Auctioneer, including and without limitation, the right to hold Buyer liable for the total purchase price, Auctioneer may, at its option, (a) cancel the sale, retaining all payments made by Buyer, including any deposit made, as liquidated damages and/or (b) resell the merchandise at public auction in which event Buyer will be liable for the cost of removing and reselling the abandoned merchandise, for any deficiency between Buyer's original purchase price and subsequent resale price, Auctioneer's commission, and legal fees. In addition, Auctioneer may retain any merchandise purchased at auction by a defaulting Buyer as collateral security for Buyer's obligations to Auctioneer. 8. All risk loss shall pass to Buyer at the time of payment. If Auctioneer is unable to deliver an article sold to Buyer due to fire, theft, or any other reasons whatsoever, Auctioneer shall reimburse Buyer for all monies paid to Auctioneer in respect to the article and Auctioneer shall have no further liability to the purchaser arising from or relating to such loss, including without limitation any damages for loss of profits. 9. In no event shall Auctioneer's liability to Buyer exceed the purchase price actually paid. A Buyer's claim shall be limited to the amount paid for the merchandise and shall not extend to any obligation; risk; liability; right; claim; remedy for loss of use, revenue or profit; liability of Buyer to any third party; personal injury; or any other direct, indirect, incidental or consequential damages. 10. The bidder's paddle/number is nontransferable. All bids made by the holder of the paddle/number will be Buyer's responsibility. A successful bid at auction constitutes a legally binding contract of sale. Auctioneer reserves the right to refuse any applicant the privilege of bidding at the auction and may revoke such privilege of bidding at the auction AT ANY TIME. 11. This sales transaction shall be governed by and construed in accordance with the local laws of the State of Oregon, USA. If any provision of these Terms and Conditions shall be held invalid, illegal, unenforceable or inoperative, the balance of Terms and Conditions shall remain in full force and affect as if such provisions had not been included. These Terms and Conditions with any amendments or modifications expressly made by Auctioneer at the time of the auction constitute all the terms and conditions with respect to the sale of articles at this auction. There are no representations, warranties, terms, conditions, undertakings or collateral agreements except as herein provided. 12. All Buyers acknowledge and accept by their bid at auction the Terms and Conditions of Sale printed on this registration card.
