By registering to bid at the auction, or by placing a bid through any means, you agree to be bound by these Terms and Conditions of Sale. In these Terms and Conditions of Sale, "we, us, our," "Palm Springs Estate Company" or similar terms mean Palm Springs Estate Company and any of its agents, and "you," "your," "buyer" or similar terms mean a person bidding on or buying property. 1. Auction Terms: Palm Springs Estate Company has made a reasonable effort to describe items correctly. However, we do not warrant the correctness of description, signatures, marks, authenticity, or condition of said items. All items are sold as "attributed" to, and AS IS. Please preview all items carefully and use your own judgement. Final decision on auction block overrides listing. ALL SALES ARE FINAL, AND ALL ITEMS ARE SOLD AS IS. THERE ARE NO WARRANTIES OR GUARANTEES OF ANY KIND. Your bid is a contract and you are bound by our terms and conditions. By agreeing to our Terms and Conditions the buyer agrees not to do any kind of chargeback on credit cards provided to Live Auctioneers. A buyer cannot initiate a chargeback, if they do, by agreeing to this contract they will lose their claim. 2. Auction Checkout: BUYERS MUST ARRANGE THEIR OWN SHIPPING. ALL SHIPPERS MUST CALL 48 HOURS IN ADVANCE OF PICKUP- NO EXCEPTIONS. ALL ITEMS MUST BE PICKED UP WITHIN 30 DAYS OF CLOSE OF AUCTION SALE. Palm Springs Auction Gallery will not be responsible for any items left thereafter. AFTER 30 DAYS ITEMS WILL BE CONSIDERED ABANDONED (unless arrangements have been made in writing and approved in writing through Palm Springs Estate Company). Once again, After 30 days items will be considered abandoned and become property of Palm Springs Estate Company without further notice. 3. Payment: LiveAuctioneers invoice PAY NOW, cash, check or bank wire ONLY. NO CREDIT CARDS/PAYPAL ARE ACCEPTED by auction house. All items must be paid within 5 business days of sale. If Invoice is not paid within 5 days a dispute will be filed. All absentee bids, online bids and phone bids must be submitted by 4 PM Pacific time one day before the auction sale. (Please note buyer?s premium on all phone bids will be 28%). In the event of a tie bid between absentee, online and floor bids - auctioneers reserve the right to give floor bid precedence. 4. FOR ONLINE PURCHASES Please review the Auction terms on whichever online platform you choose to bid. Your bid is a contract. In the event of a tie bid between in house, absentee and phone and online - auctioneer has the right to give floor bid precedence. All auction purchases must be paid within five business days of the auction. If you have not contacted Palm Springs Estate Company to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
