DBA as ABSOLUTE AUCTION GALLERY (ABSOLUTE), will be governed by OUR auction terms & conditions. Any & ALL legal actions brought forward shall be governed and enforced in accordance with the laws of the state of Florida. Whether bidding in person or by agent, absentee bid, telephone or other means, the buyer shall be deemed to have consented to the jurisdiction of the state courts and the federal courts within Broward County State of Florida. 2. Auction Preview: ALL items are available for examination prior to sale by appointment only. ALL merchandise SOLD AS IS, WHERE IS, we try to describe all items accurately, in the event we fail to mention a flaw on our descriptions, please review our photos as they form an IMPORTANT PART of our DESCRIPTIONS. Keep in mind that there will be color screen variations, we WILL not be held liable for those variations. By bidding on our auction, you have either agreed to NOT inspect, to inspect the item personally, or have the item inspected by a third party and form your OWN opinion as to condition, value, originality, and all matters. 3. ALL our statements are merely OUR opinions, these include but are not limited to Condition Report, Authenticity, and Market value. All statements, written, verbal, made in the catalog, advertisement, invoice, bill of sale, shipping statement, posting, announcement, comment by the auctioneer, or otherwise, should NOT be deemed as any warranty or assumption of liability. 4. Please note that for Framed items, the item will be SOLD AS IS (framed), ABSOLUTE will NOT be held Liable for any flaws that arise from the removal of a frame after the sale is complete. 5. No written or implied warranty is made regarding the working condition of watches, clocks, electronic or mechanical devices of any sort or that any such item is in working condition or without defects, restorations, or replacement parts. 6. All measurements and weights are approximate. 7. All Sales are FINAL, Refunds are offered ONLY if an item is found to be forged. REFUND request MUST have a written report of a recognized expert in the field (paid for by the buyer & not affiliated to the buyer) that states beyond a reasonable doubt that the item in question is FORGED, within 15 days of receipt of the item, the item must be returned in the same condition as purchased. NO cost associated with shipping from and to our warehouse will be refunded, ONLY FULL purchase price & buyers premium will be refunded. 8. Phone Bids & Absentee Bids: Arrangements for bidding can be made by completing and submitting either form by 5:00 pm the day prior to sale day. This form can be obtained by email request, at our web page, or at our warehouse. All bids must be secured with a credit card number. 9. ABSOLUTE will make all reasonable efforts to contact the phone bidders, to execute absentee and on-line bids, but accepts no liability for the failure to reach phone bidders, for any errors or omissions, electronic mail receipt, equipment failure, inability to access the internet, software malfunctions, or any losses incurred as a result of failure to execute bids. 10. Reserve Price: in most cases the reserve will not exceed the low estimate and/or starting price. The auctioneer may, in his/her sole discretion, refuse any bid, advance the bidding, or withdraw any lot. In the case of an error or dispute during or after the auction, the auctioneer may in his/her sole discretion determine the successful bidder, continue the bidding, cancel the sale, or re-offer the item in dispute. In the event of a dispute after the sale, ABSOLUTE'S record is conclusive and binding on all parties. Winning Bid: The winning bid is the highest bid acknowledged by the auctioneer. In the event of a tie bid, the winning bid will be determined by the auctioneer, ABSOLUTE'S record is conclusive. 11. In the event of a buyer winning several lots and not paying for a particular lot, ABSOLUTE will cancel the sale of the particular lot and all other lots won and paid for by the same buyer, buyer will be liable for the total purchase price of ALL lots, ABSOLUTE will retain ALL partial payments made by the buyer, & resell the ALL lots won by the buyer either privately, or at public auction. Buyer will be banned from all future auctions.
