Hubbard Burdett LLC - Terms & Conditions Welcome to the Hubbard Burdett LLC online auction services conducted through LiveAuctioneers.com. By participating in our auctions, you agree to the following terms and conditions. Please read them carefully. 1. Introduction These Terms & Conditions ("Terms") govern the use of the online auction services provided by Hubbard Burdett LLC ("Company," "we," "us," or "our") through the LiveAuctioneers.com platform. By registering for and using our auction services, you ("User," "Bidder," "Buyer," or "Seller") agree to be bound by these Terms, as well as the terms and conditions of LiveAuctioneers.com. 2. Registration 2.1. Eligibility: Users must be at least 18 years old and capable of entering into a legally binding agreement. 2.2. Account Information: Users must provide accurate and complete registration information and keep their account details up to date. Registration on LiveAuctioneers.com is required to participate in our auctions. Hubbard Burdett LLC may use this information to contact the User, including for follow-up communications such as requesting reviews, offering subscriptions, or sharing updates related to our services. 2.3. Account Security: Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. 3. Bidding 3.1. Bidder Agreement: By placing a bid, the bidder agrees to purchase the item if they are the highest bidder at the auction's close. 3.2. Binding Bids: All bids placed are binding and cannot be retracted unless the Bidder contacts LiveAuctioneers to request bid cancellation. Hubbard Burdett is unable to alter any bids on the LiveAuctioneers platform. 3.3. Bid Increments: Bids must be placed in the increments specified for each auction. 3.4. Winning Bids: The highest bid at the close of the auction period will be deemed the winning bid, subject to any reserve price that may apply. 4. Payment 4.1. Invoices: Winning bidders will receive an invoice via email within 24 hours of the auction close but usually will be directly after the auction ends. 4.2. Autopay: This auction uses Autopay by LiveAuctioneers. If you place a winning bid, your card will be charged shortly after the conclusion of the auction. LiveAuctioneers may put a secondary hold on your card to cover the shipping costs. If this occurs, once the shipping price is established, the difference will be returned. 4.3. Payment Terms: Payment must be made no later than [3] business days of the auction's close. 4.4. Premium: A buyer's premium, as specified in the auction details, will be added to the hammer price of each item sold. 5. Shipping 5.1. Shipping Costs: The buyer is responsible for all shipping and handling costs. Once the original invoice has been paid, Hubbard Burdett will pack the items to compile the exact shipping costs in no more than 5 business days. Hubbard Burdett will then adjust the invoice accordingly and resend it to the Buyer. Once shipping costs are cleared, we will ship the item. Hubbard Burdett will also submit the customer's email address for all shipping notifications from the provider. 5.2. Fragile Items: If an item is extremely fragile or requires insurance, the item must be packed and sent by a service provider. The Buyer is responsible for all costs. 6. Item Descriptions 6.1. Accuracy: We strive to provide accurate descriptions and photographs of auction items. However, all items are sold "as is," and we make no warranties or representations regarding the accuracy of descriptions. 6.2. Inspection: Buyers are encouraged to inspect items or request additional information before bidding. 7. Returns and Refunds 7.1. All Sales Final: All sales are final. No returns or refunds will be accepted unless an item is significantly not as described. 8. Liability 8.1. No Liability for Platform Issues: Hubbard Burdett LLC is not responsible for any issues or downtime related to the LiveAuctioneers.com platform. 8.2. No Liability for Damages: We are not liable for any damage or loss to items after they have been sold, though we will take reasonable precautions to protect items while in our possession. 8.3. Indemnity: Users agree to indemnify and hold harmless Hubbard Burdett LLC from any claims, damages, or expenses arising out of their use of the auction services. 9. Marketing Communications 9.1. Consent to Contact: By registering for our auction services, you consent to receive communications from Hubbard Burdett LLC via phone, email, or other methods regarding your participation in auctions, as well as for follow-up purposes such as requesting reviews, offering subscriptions, or sharing updates and promotions related to our services. 9.2. Opt-Out: You have the right to opt out of receiving marketing communications at any time by following the unsubscribe instructions provided in any email or by contacting us directly. 10. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. 11. Amendments We reserve the right to modify these Terms at any time. Changes will be posted on our website, and continued participation in our auctions will constitute acceptance of the modified terms.
