1. Acceptance of Terms By registering to bid, receiving a bidder number, or participating in any sale - whether in person, absentee, phone, or online - you agree to these Terms & Conditions. These terms may be amended at any time and become effective immediately when posted. 2. Auction House Roles Witherell acts solely as agent for the Consigner. Titles passes directly from Consigner to Buyer upon the fall of the hammer or equivalent confirmation. 3. Condition, Inspection, & Warranties All property is sold "AS-IS, WHERE-IS, WITH ALL FAULTS." No warranties - express or implied - are made regarding condition, authenticity, provenance, attribution, age, completeness, or fitness for purpose. Bidders must rely on their own inspection or that of an agent. 4. Bidding Process & Acceptance The auctioneer has exclusive discretion to open, reject, or reopen bidding; resolve tie bids; withdraw lots; or correct catalog errors. The highest bid recognized by the auctioneer is the winning bid. All absentee, phone, and online bidding is at the bidder's own risk. 5. Buyer's Premium & Additional Fees Buyer's Premium: 25% for in person or absentee bids; 26% for phone bids; 28% for online bids. Add 3% for credit card payments. Buyers are responsible for shipping, handling, and the 1.5% insurance premium unless waived in writing. 6. Sales Tax Purchases picked up in California are subject to 8.75% tax. Shipments within California or Nevada are taxed at the rate of the delivery address. Valid California resale certificates are accepted. Out of state resale certificates are not valid for California pickup. Items shipped outside California or Nevada via recognized carriers may be tax exempt. 7. Payment Terms Payment is due immediately upon receipt of invoice. Accepted forms include cash, cashier's check, wire transfer, or approved credit card. Late payments may accrue interest up to 18% annually plus collection fees. Witherell may rescind a sale for nonpayment. 8. Shipping, Insurance, & Pickup Items are released only after full payment clears. Shipping is via recognized carriers; buyers pay packing, shipping, and insurance (1.5% unless waived). Items not picked up within 5 business days may incur storage and handling fees. 9. No Returns All sales are final. No refunds or rescissions. Descriptions, condition reports, and photographs are opinions only and not guarantees. 10. Absentee, Phone, & Online Bidding Absentee, phone, and online bidding are offered as a courtesy. Witherell is not liable for technical issues, missed bids, dropped connections, or failures to execute bids. 11. Remedies for Default If Buyer fails to comply with these terms, Witherell may cancel the sale, resell the lot, retain payments, or pursue legal remedies, including damages and costs. 12. Limitation of Liability Witherell's liability for any claim is limited to the amount actually paid by Buyer for the lot. No consequential or incidental damages are permitted. 13. Governing Law & Venue These terms are governed by the laws of the State of Nevada. Venue for disputes shall be Douglas County, Nevada. Buyer consents to jurisdiction therein.
