TERMS AND CONDITIONS

PLACING A BID AT THIS PARKER-BRADEN AUCTION CONDUCTED THROUGH EBAY LIVE AUCTIONS CONSTITUTES AGREEMENT TO ABIDE BY THE FOLLOWING TERMS AND CONDITIONS OF SALE.

1. A 15% Buyer’s Premium will be added to all winning bids and is considered part of the purchase price.

2. All payments must be made in U.S. Funds to Parker-Braden Auctions by Visa, MasterCard, American Express, Cashier’s Check, or Money Order. Payment is due immediately upon notification of winning bids Without Exception. Payment may be made with credit cards by phone (1-800-748-3946) or by e-mail (livebid@starband.net) or by mail at P.O. Box 1897, Carlsbad, NM 88221-1897.

3. All items sold are subject to New Mexico Gross Receipts Tax at a rate of
6.4375 % unless a tax exemption certificate is furnished with payment. Items
shipped out of New Mexico are considered tax-exempt.

4. Packing, shipping, and insurance costs are NOT included as part of the purchase price. Parker-Braden Auctions will pack and ship merchandise at the most reasonable rate possible.. Please call 505-885-4874 for information on shipping. Any items that require shipment by motor freight will be delivered to a crating and shipping agency free of charge within 30 days. Any items left past 30 days will be assessed storage charges.

5. Although every effort has been made to accurately describe every item, Parker-Braden makes no actual guarantee as to age, size, authenticity, or restoration. In the event of any discrepancy of description, Parker-Braden may elect, at our sole discretion, to allow the return of certain items. In no case will Parker-Braden ever be liable for more than the purchase price plus shipping costs. Any return must be arranged within 5 days of the receipt of merchandise, and must be in our possession within 30 days from the date of the auction.

6. Unless stated on an individual lot, all items will be sold without minimums or reserves. The estimated prices are merely a guide. Actual selling prices may be higher or lower than estimates.

7. The Auctioneer has sole discretion to handle any tied bids or disputed bids. Auctioneer retains the right to reject any and all bids, and to advance the bidding at his discretion.

8. Bidding on any item signifies full knowledge and acceptance of the above conditions. All sales are final and items must be paid for immediately upon notification by Ebay of the amount owed. This agreement is binding upon the parties involved. In the event any litigation shall arise, exclusive jurisdiction shall be in the New Mexico District Court for Eddy County, New Mexico.
