BIDDER TERMS AND CONDITIONS: By bidding on items at this auction you are bound the terms and conditions set forth by Appraisal & Estate Sale Specialists, Inc. 1. No lot will be released to the buyer until payment in full has been made to Appraisal & Estate Sale Specialists, Inc. including the buyer's premium and any applicable taxes and funds have been cleared. Payment must be received within three(3) business days from the date of sale. If payment has not been received within the three day period and no other arrangements have been agreed to in writing, the buyer will be subject to storage and late fees to be determined by Appraisal & Estate Sale Specialists, Inc. These fees will not exceed $10.00 per lot, per day. 2. All funds shall be paid in US dollars. 3. All property is sold "AS IS & WHERE IS" neither Appraisal & Estate Sale Specialists, Inc. nor the seller makes any express or implied warranty or representation as to the condition of any lot offered for sale, and no statement made at any time, whether oral or written, shall constitute such warranty or representation. Descriptions or conditions are not warranties. The descriptions of the conditions of articles in this catalogue, including all references to damages or repairs, are provided as a service to interested persons and do not negate this paragraph. We strongly encourages you to attend the scheduled inspection for this auction, which will take place before the start of the auction, if you choose not to attend the scheduled inspection and are in doubt about the condition, completeness or suitability of a given item, please ask a question or bid accordingly. Buyer’s obligation to inspect each item: Buyers are strongly encouraged to view all items auctioned before the auction to determine the true condition and nature of any item(s) of interest. 5. Winning Bids: If you place a bid in this sale, and your bid is determined to be the winning bid, you become obligated to pay for the item that you have won at the price you gave as your bid. 6. The purchase price payable by a buyer will be the sum of the hammer price plus the buyer's premium as well as 8% sales taxes to California buyers. 7. Sales Tax: Sales tax will be collected on items purchased at this auction. If you are a California buyer, an 8% sale tax will be added unless you have a valid resale number and have completed a signed BOE-230 (7-02) form on file with Appraisal & Estate Sale specialists, Inc. otherwise sales tax will be applied. Shipping: DOMESTIC SHIPPING: $8 Priority Mail up to 5 items, additional $2 per item over 5 items. INTERNATIONAL SHIPPING: Please ask for a quote as prices vary by country. SPECIAL NOTE: Our auctions are listed worldwide but due to governmental restrictions, certain items may not be available for shipping to some locations or countries. Please keep this in mind when bidding. An 18% buyer premium will be added to all bids. This means that if your winning bid is $100, you will be charged $118.00 (and sales tax if needed) when checking out. 10. Release upon Presentation of Receipt: You understand and agree that Appraisal & Estate Sale Specialists, Inc. will release your items only after you or your agent presents a sales receipt generated by Appraisal & Estate Sales Specialists, Inc. stating that your account is paid in full. You further understand and agree that it is your duty to ensure that any agent picking up items on your behalf has a copy of your paid sales receipt to present at the pick-up location. You explicitly authorize Appraisal & Estate Sales Specialists, Inc. to release your items to any person in possession of your paid sales receipt. No item will be released to any person unless that person presents a paid sales receipt listing the item in question. Any agent picking up for your will be Required to also signed a document stating that they have picked up your item from Appraisal & Estate Sale Specialists, Inc. 11. Winning Bid Constitutes an Immediate Transfer of Title: Title to the offered lot shall pass to the buyer upon the fall of the auctioneer's hammer and announcement by the auctioneer that the lot has been sold, subject to compliance by the buyer with all other Conditions of Sale. The buyer shall forthwith assume full risk and responsibility for the lot and shall pay the full purchase price including buyer’s premiums and sales tax. For internet auctions, title is transferred immediately at the close of that auction. All sales are final. NO refunds will be given and no charge backs will be allowed. 12. The exclusive venue for resolving any disputes arising from, or related to, this auction shall be in the county of Orange and located in the state of California. 13. Liability: In all cases, Appraisal & Estate Sale Specialist, Inc. liability, and the liability of the seller of the items in this auction, will be limited to the refund of your purchase price. Appraisal & Estate Sale Specialists, Inc. will not be liable for any amount in connection with the postponement or cancellation of this auction, or the withdrawal of any item or lot from this auction. In no event will Appraisal & Estate Sale Specialists, Inc. be liable for lost profits or any special, incidental, or consequential damages arising out of or in connection with this auction or any related sale or transaction. 14. No Liability for Site Malfunction: You understand that this auction is online-only, and so relies on devices and programs that may malfunction without warning. You agree that Appraisal & Estate Sale Specialists, Inc. will not be liable for any error or inconvenience that may be the result of such a malfunction. You further understand and agree that Appraisal & Estate Sale Specialists may void or suspend any sale, or resell any item; Appraisal & Estate Sale Specialists, Inc. shall have final say as to who determines a transaction that been affected by any site malfunction. 15. Indemnification: You agree to indemnify, defend, and hold harmless Appraisal & Estate Sale Specialists, Inc. and its employees, officers, owners, affiliates, agents, and representatives from and against any claims, losses, damages, liabilities, judgments, fees, costs, and expenses, including reasonable legal fees and costs, related to, arising from, or associated with you, your agents or representatives – including, but not limited to, personal injury or property damage caused at any sales site or during removal or transportation of items won at auction, any dispute with another bidder, or any violation of these Terms and Conditions. 16. Condition: Any description given towards condition are an opinion only and not a warranty. 17. No lots will be removed from the auction house until full purchase prices have been paid and all terms and conditions fulfilled. All winning bids must be paid for by three(3) business days. ** All items that have not been paid for after two weeks from auction close will be considered forfeited and the auctioneers reserve the right to re-auction the property. 18.
