no opportunity of right of withdrawal
I bought a marble vase that apparentely seemed to be sane, no defects were mentioned in the description which also indicated the presence of the original box, so it looked accurate. Therefore the vase was delivered in the original damage-proof packaging but arrived completely damaged. We asked the auctioneer and they answered that it showed signs of stress already at the time of sale but that the fault was attributable to the poor transporter as the vibrations or the difference in internal and external temperatures would have made the cracks open in an inexorable and irreparable way. We asked to be able to exercise the right of withdrawal as the purchase had been made via the internet and the response was that the exhibition was open before the sale and that we could have seen it before so they do not accept the return (please note I live in Italy and they are in Germany). This is foolish and outlawed, and especially a seriously injured item should not be offered for sale. Nonsense reply, commercially and intellectually; difficult to establish a working relationship, it was humiliating.

Dear Sir, as we already explained, according to German law there is NO right of withdrawal in public auctions with the opportunity to visit a preview, ask for condition reports or additional detail pictures. You did not ask for a condition report in advance, which we always offer. The object left our house in good condition, the minimal cracks (which of course were mentioned in our condition report) were closed and hardly noticable. We are very sorry about the damage, but you instructed your own transport company to pick up the object at our auction house and the damage happened during the transport. So it is not our mistake and we are the wrong address to handle your problem. Your transport company takes over the risk from the moment they receive the object from our auction house. My experience with Kunst & Design Auktionhaus
Overall I was satisfied with my purchase experience with K & D. The only disappointment with the item is that there was more usage wear on the vase I purchased than what was reflected in the photos. I was bidding from overseas, so I was not able to view the item in person. I probably would have bid on the item regardless of the wear, but I probably wouldn't have bid as high as I did, The staff and all of my contact with K & D was excellent. The staff is extremely courteous and helpful. The item was packed well for shipment and arrived safe and sound to the New York City where I reside. I would bid again with K & D.
