October 22 Fine Estates Auction

The October 22, 2021 Fine Estates Auction is an online only auction. All bidding will take place online. By registering to bid and/or submitting any bid, you acknowledge and accept these terms and conditions. We thank you for your interest and participation. REGISTRATION - In order to bid in this auction on the Live Auctioneers platform, you must register online through Live Auctioneers. - Bidders with no or limited history with Briggs Auction may be required to provide us with additional information that may include but may not be limited to: - A photo or scan of their driver's license - A photo or scan of a current utility bill with name and address matching the driver's license and submitted bidder registration details. - ALL BIDDERS MUST BE REGISTERED AND APPROVED BY 5PM on THURSDAY, OCTOBER 21, 2021. WE WILL NOT APPROVE BIDDERS FOR THIS AUCTION AFTER 5PM ON OCTOBER 21, 2021. BIDDING - Owner or Owner's Agent may not bid on his/her own items. - The Auction record kept by Auctioneer and Clerk is final. - The highest bidder for each lot shall be the buyer, and if any dispute arises as to any bidding, or between two or more bidders, the auctioneer will have sole discretion to determine the successful bidder, or the disputed lot shall be offered again at the last undisputed bid and resold. BUYER'S PREMIUM / SALES TAX - The Buyer's Premium of 25% will be added to each successful bid. - PA Residents and all buyers who pick up merchandise in person are required to pay PA State Sales Tax (6%) on each sale, including the buyer's premium, unless exempted by law. If exempt in PA, you must present us with a valid exemption number. - Live Auctioneers will collect sales tax in all other states as applicable. If you have a tax exemption number, you must add it to your Live Auctioneers account. We are unable to remove sales tax from an invoice if there is no tax exemption certificate registered to the account. - Note: your sales tax exemption must be from the same state as your shipping address in order for sales tax to be removed. PAYMENT - Successful bidders will be provided an invoice and payment details to the email address associated with their Live Auctioneers account following the auction. - Full payment via Live Auctioneers "Pay Now" button, or by Wire Transfer is required within fourteen (14) days following the auction. - Any invoice over $10,000 must be paid by Wire Transfer. MERCHANDISE PICKUP | SHIPPING | STORAGE FEES - All items must be removed from Briggs Auction or have shipping arrangements made within twenty-one (21) days of the auction. After 21 days, a $5/day storage fee will be applied. - No item may be removed or will be released for shipping until full payment of merchandise and/or any applicable sales tax or storage fees has been made. - All items that have been paid for and not removed from Briggs Auction after 90 days will be deemed abandoned, and will become property of Briggs Auction. Merchandise Pickup: - Merchandise pickup hours are Monday-Friday by appointment only (see BriggsAuction.com to schedule); Saturdays from 9AM-3PM with no appointment needed. - Buyers are responsible for packing smaller items; please ensure that you have your own packing materials and equipment needed to collect your items. Please call ahead if you will require help with moving/loading furniture. - Bidders who pick up their purchased items in person are responsible for examining all items at the time of pickup and assuring themselves as to condition before removing any item from Briggs Auction, Inc. No item may be returned for condition issues once it has been removed from Briggs Auction, and no refund or merchandise credit will be offered for any item's condition after it has been picked up and removed by the bidder. Shipping: - Briggs Auction does not ship, however we work with a variety of shippers who can handle anything in the auction. View our Shippers List on www.briggsauction.com/shipping. - All shipping, packing, and handling costs are the responsibility of the buyer. - Items will only be shipped to the bidder's listed shipping address. - Third-party pickups also require advanced scheduling. Please have your shipper contact Briggs Auction not less than 24 hours prior to requested pickup time to arrange. - Briggs Auction requires WRITTEN authorization to release merchandise to anyone other than the registered bidder. Please use our Shipping Authorization Form on our website. MERCHANDISE OFFERED - All items are sold AS IS, WITHOUT GUARANTEE. We urge you to request additional condition details and photographs to allow you to bid according to your own expertise. - Lot announcements, listings, photographs, and catalog information are for descriptive purposes only. Items with power cords are not tested prior to the auction. - Any condition details listed are offered as courtesy to bidders, and are opinions only, not statements of fact, and do not imply any warranty concerning condition, or any assumption of liability. The absence of a condition report does not imply that the lot is perfect or free from wear, flaws, or characteristics of age. Briggs Auction, Inc. is not responsible for errors and/or omissions of condition. - By participating in Briggs Auction, Inc.'s auction, you are agreeing that the auction is occurring in Pennsylvania, merchandise is being struck off in Pennsylvania, contract of sale is being entered in Pennsylvania, and payments will be made in Pennsylvania. - All announcements made on the day of the auction supersede any other previously announced or published materials. - It is the buyer's responsibility to be informed of any import laws of their country. All taxable items in this auction, including the buyer's premium, are subject to the sales tax charged by the state shown on the bidder's Live Auctioneers registration. Bidders who pick up their items in person will be charged the PA 6% sales tax, and bidders who have items shipped will be charged the tax rate of the bidder's shipping address in their Live Auctioneers registration, unless you provide Live Auctioneers with a photo/scan/PDF of a current, valid tax exemption license.
