Damages are defined as Buyers Premium, $50 per lot listing fee, and $25 per lot daily storage fee. Pangaea Auctions will arrange shipping with the seller. Shipping costs will include shipping insurance, and applicable handling fees. Any lots that are damaged during, or after shipping, shall not be returned to or refunded by Pangaea-Auctions under any circumstances. Pangaea-Auctions enforces its insurance policy and verifies it prior to the seller shipping the lot. FedEx shipping claims must be filed within 24 hour of signed delivery. We are not liable for shipping damage but will coordinate the process if emailed within this 24hr window. Bidder's are responsible for shipping costs associated with any Fedex claim. WARRANTIES: Pangaea-Auctions does not give any warranties on any lots sold at auction, and does not make any guarantees to the estimated value of any lot. Our descriptions are simply suggestions and we do not make any claims to the representations of the quality, origin, value, marketability, or age of any lots. It is up to the buyer at his/her discretion and expense to determine the market value of the lots within our auction. AUTHENTICITY: If within 10 calendar days after the auction date, any lot the purchaser gives notice in writing to Pangaea-Auctions that a lot is counterfeit that was described as "authentic" or "certified", and the purchaser within 10 calendar days after the auction date demonstrates evidence to Pangaea-Auctions by providing a legally notarized affidavits by two (2) recognized industry experts in the field of the particular lot stating that the lot is in fact counterfeit, Pangaea-Auctions will coordinate a refund from the seller to the buyer for the hammer price. In situations in which the lot can only be qualified by a single source such as the artist or represented gallery, a legal notarized affidavit must be provided within 10 days of the auction. If the lot is damaged in any way, shape or form the refund will be null and void. All lots must be returned in the exact condition as their photos. ARBITRATION: All disputes that cannot be resolved between the buyer and seller will be determined by the State of Nevada. Buyer expressly agrees to such Arbitration, and gives up its constitutional right to have any such dispute decided in a court of law before a jury. Such arbitration award shall be final and binding and may be taken to a court of competent jurisdiction and judgment may be entered thereon. As a bidder you are agreeing that all issues/disputes will be determined through an arbitrator and that you are giving up your right to take the dispute to a court trial.
