MARC GAUDET-BLAVIGNAC COMMISSAIRE-PRISEUR ************* ONLINE ONLY AUCTIONS / GENERAL CONDITIONS Participating to our auction induces a full acceptation of the the following conditions, without any reserve: 1. The auction is based on CHF (Swiss francs). An invoice will be established for the winning bidder in this currency. In the case the winning bidder wishes to be invoiced in another currency, conversion will be indicatively effected on demand. 2. The adjudication will be effected in favor of the last bidder. In case of dispute, the adjudication will be cancelled and the lot will be immediately reput for sale. 3. The lots are sold, following their catalogue number. For each lot, an appraisal is provided, as well the starting price. The auctioneer reserves the discretionary right to change the order of the catalogue and/or to split or join any lots. The auctioneer also reserves the discretionary right to withdraw any lot from the auction, and/or to interrupt the auction. The bid made by a bidder is irrevocable and definitive. 4. The bids must be transmitted clearly to the auctioneer. The increment during the auction is 10%. The auctioneer reserves the discretionary right to modify the increment. In this case, the modification will be announced before. 5. The auctioneer?s premium is 20% on the hammer-price. For domestic bidders, VAT 8% rate is applied on the premium. Foreign bidders are deemed to pay the VAT costs directly to their domestic customs, at receipt of the lot. 6. The lots are sold in the physical condition they are at the time of the adjudication. They correspond to the descriptions given in this catalogue, which are produced in good faith. As well, the descriptions must not be considered as a guarantee of authenticity. Eventually, the documents of expertise regarding the lots will be mentioned and provided to the winning bidder. Any questions regarding condition of the items must be asked before the auction starts. The returns are accepted only, in the case the lot would not suit the description given, in an important and significant manner and following a motivated demand, received within 3 days after the buyer?s receipt of the lot. 7. The absentee bids (written bid orders) are accepted. They must be accompanied by the complete whereabouts of the bidder: name and address; bank whereabouts; credit card number; copy of ID document. The absentee bids demands must be received 24 hours max. before the auction starts. When several absentee bids have been received for the same lot at the same amount, the first received absentee bid prevails. 8. Profits and risks are transmitted to the winning bidder (hereby, the buyer) at the time of the adjudication. The propriety of the lot is transmitted only at the time the payment is received by the auctioneer. The lots are sold FOB Geneva, Switzerland (hammer price and premium). The FOB payment must be received by the auctioneer, within 3 days after the auction?s closing. The buyer can pay by the 3 following ways: cash; bank transfer; Paypal (+3,5% additional rate). No checks will be accepted. The lots must be removed/shipped at the risks and costs of the buyer. Shipment facilities will be indicated by the auctioneer, case per case and invoiced separately. No item will be retired/shipped without full payment received (FOB and shipment costs). Any taxes due abroad are to be fully borne by the buyer, which must comply with any customs regulations abroad. We do not assume any responsibility for any damage resulting from the breach of such regulations. 10 days after the auction, the unpaid/unshipped items will be put in storage at the risks and costs of the buyer. In case of non-payment or partial payment, the auctioneer may levy a 5% monthly interest on all amount still due. 9. The person who would disturb the good settlement of the auction is deemed to police pursuits. 10. All disputes and differences will be settled under swiss laws, not including private international laws, before the Geneva courts, whatever the country or place of residence of the parties. *************
